 1                    AMENDMENT TO HOUSE BILL 1822

 2        AMENDMENT NO.     .  Amend House Bill 1822 as follows:

 3    on page 1, below line 18, by inserting the following:

 4        "Devastating insect or plant disease - An insect or plant
 5    disease, for which a quarantine  exists,  that  the  Director
 6    determines could have a serious and devastating effect on the
 7    nursery industry or environment."; and

 8    on  page  3,  line 3, by replacing "$1,500 $150" with "$150";
 9    and

10    on page 3, line 21, by replacing "$3,000 $300"  with  "$300";
11    and

12    on  page  3, line 32, by replacing "$5,000 $500" with "$500";
13    and

14    on page 4, by replacing line 11 with the following:

15        "IV.  A fine of not less than $500 but not  greater  than
16    $5,000  shall be imposed for each of the following violations
17    related to a devastating insect or plant disease:
18             A.  Thwarting  or   hindering   an   inspection   by
19        misrepresenting or concealing facts or conditions related
20        to compliance with the terms of the quarantine.

 1             B.  Selling,  offering  for  sale,  or  distributing
 2        nursery stock or other articles infested with devastating
 3        insects or plant diseases in violation of the quarantine.
 4             C.  Failing   to   carry   out   the   treatment  or
 5        destruction of any devastating insect or plant disease or
 6        regulated article as required  under  the  terms  of  the
 7        quarantine  and  in accordance with official notification
 8        from the Director.
 9             D.  Moving any regulated article into or out of  the
10        quarantined  area  unless  the regulated article has been
11        treated or handled as provided by the requirements of the
12        quarantine.
13             E.  Falsifying  a  compliance  agreement  under  the
14        quarantine.".
