 1        AN ACT concerning vaccinations in health facilities.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Life Care Facilities Act  is  amended  by
 5    adding Section 10.1 as follows:

 6        (210 ILCS 40/10.1 new)
 7        Sec. 10.1.  Vaccinations.
 8        (a)  A   facility   shall  document  evidence  of  annual
 9    vaccination against influenza for each resident who is age 60
10    or  over  in  accordance  with  the  recommendations  of  the
11    Advisory Committee on Immunization Practices of  the  Centers
12    for  Disease  Control  and Prevention that is  most recent to
13    the time of vaccination, unless the vaccination is  medically
14    contraindicated  or  the  resident  has  refused the vaccine.
15    Influenza vaccinations for all  residents  age  60  and  over
16    shall  be  completed  by November 30 of each year.  Residents
17    admitted after November 30, during the flu season, and  until
18    February  1  shall,  as  medically  appropriate,  receive  an
19    influenza  vaccination  prior  to  or  upon admission, unless
20    refused by the resident.
21        (b)  A facility shall document  evidence  of  vaccination
22    against  pneumococcal disease for each resident who is age 60
23    and over  in  accordance  with  the  recommendations  of  the
24    Advisory  Committee  on Immunization Practices of the Centers
25    for Disease Control and Prevention that is most recent to the
26    time of vaccination,  unless  the  vaccination  is  medically
27    contraindicated  or  the resident has refused the vaccine.  A
28    facility  shall   provide   or   arrange   for   pneumococcal
29    vaccination   of   residents   who  have  not  received  this
30    immunization prior to or  upon  admission  to  the  facility,
31    unless the resident refuses the offer for vaccination.

 1        Section  10.   The  Nursing  Home  Care Act is amended by
 2    changing Section 2-213 as follows:


 3        (210 ILCS 45/2-213)
 4        Sec. 2-213.  Vaccinations.
 5        (a)  A  facility  shall  document  evidence   of   annual
 6    vaccination against influenza for each resident who is age 60
 7    or  over  in  accordance  with  the  recommendations  of  the
 8    Advisory  Committee  on Immunization Practices of the Centers
 9    for Disease Control and Prevention that is most recent to the
10    time of vaccination,  unless  the  vaccination  is  medically
11    contraindicated  or  the  resident  has  refused the vaccine.
12    Influenza vaccinations for all  residents  age  60  and  over

28    unless  the  resident  refuses  the  offer  for  vaccination.
29    Pneumonia shots.  Before a prospective  resident's  admission
30    to  a  facility  the  facility  shall  advise the prospective
31    resident to consult a  physician  to  determine  whether  the
32    prospective  resident  should  obtain  a  vaccination against

 1    pneumococcal pneumonia.

 3        Section 99.  Effective date.  This Act takes effect  upon
 4    becoming law.
