 1        AN ACT to  amend  the  Mental  Health  and  Developmental
 2    Disabilities Code by adding Section 2-110.5.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The   Mental   Health   and   Developmental
 6    Disabilities  Code  is  amended  by adding Section 2-110.5 as
 7    follows:

 8        (405 ILCS 5/2-110.5 new)
 9        Sec. 2-110.5.  Electro-convulsive therapy for minors.  If
10    a recipient is a minor, that recipient's parent  or  guardian
11    is  authorized, only with the approval of the court under the
12    procedures set out in Section 2-107.1, to provide consent for
13    participation of the minor in electro-convulsive  therapy  if
14    the parent or guardian deems it to be in the best interest of
15    the  minor.   In  addition  to  the  requirements  in Section
16    2-107.1, prior to  the  court  entering  an  order  approving
17    treatment   by   electro-convulsive   therapy,   2   licensed
18    psychiatrists,  one  of  which  may  be  the minor's treating
19    psychiatrist, who have examined the patient  must  concur  in
20    the  determination  that  the  minor  should  participate  in
21    treatment by electro-convulsive therapy.

22        Section  99.  Effective date.  This Act takes effect upon
23    becoming law.
