 1        AN  ACT  to  amend  the  Medical  Practice Act of 1987 by
 2    changing Section 2.

 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:

 5        Section  5.   The Medical Practice Act of 1987 is amended
 6    by changing Section 2 as follows:

 7        (225 ILCS 60/2) (from Ch. 111, par. 4400-2)
 8        Sec. 2.  Definitions.  For  purposes  of  this  Act,  the
 9    following  definitions  shall  have  the  following meanings,
10    except where the context requires otherwise:
11        (1) 1.  "Act" means the Medical Practice Act of 1987.
12        (2) 2.  "Department" means the Department of Professional
13    Regulation.
14        (3) 3.  "Director" means  the  Director  of  Professional
15    Regulation.
16        (4)   4.    "Disciplinary   Action"   means   revocation,
17    suspension,  probation,  supervision,  practice modification,
18    reprimand, required education,  fines  or  any  other  action
19    taken by the Department against a person holding a license.
20        (5)   5.    "Disciplinary   Board"   means   the  Medical
21    Disciplinary Board.
22        (6) 6.  "Final Determination" means the governing  body's
23    final  action  taken under the procedure followed by a health
24    care institution, or  professional  association  or  society,
25    against  any person licensed under the Act in accordance with
26    the bylaws or rules  and  regulations  of  such  health  care
27    institution, or professional association or society.
28        (7) 7.  "Fund" means the Medical Disciplinary Fund.
29        (8)   8.  "Impaired"  means  the  inability  to  practice
30    medicine with reasonable skill and safety due to physical  or
31    mental  disabilities  as evidenced by a written determination

 1    or written  consent  based  on  clinical  evidence  including
 2    deterioration  through  the  aging  process  or loss of motor
 3    skill, or abuse of drugs or alcohol, of sufficient degree  to
 4    diminish  a  person's  ability  to  deliver competent patient
 5    care.
 6        (9) 9.  "Licensing Board"  means  the  Medical  Licensing
 7    Board.
 8        (10  10.  "Physician"  means  a person licensed under the
 9    Medical Practice Act to  practice  medicine  in  all  of  its
10    branches  or a chiropractic physician licensed to treat human
11    ailments without the  use  of  drugs  and  without  operative
12    surgery.
13        (11) 11.  "Professional Association" means an association
14    or  society of persons licensed under this Act, and operating
15    within the State of Illinois, including but not  limited  to,
16    medical    societies,    osteopathic    organizations,    and
17    chiropractic organizations, but this term shall not be deemed
18    to include hospital medical staffs.
19        (12)  12.  "Program  of  Care,  Counseling, or Treatment"
20    means  a  written  schedule  of  organized  treatment,  care,
21    counseling, activities, or  education,  satisfactory  to  the
22    Disciplinary  Board, designed for the purpose of restoring an
23    impaired person to a condition whereby  the  impaired  person
24    can  practice  medicine with reasonable skill and safety of a
25    sufficient degree to deliver competent patient care.
26        (13)  "Surgery" means a field of practice  that  consists
27    of diagnosis or treatment of diseases, conditions, injury, or
28    deformity  of  human  tissue  by  (a)  mechanical  means, the
29    application of heat or cold, cryotherapy, or sonic waves,  or
30    (b)  operative  surgery  which  consists  of  any  procedures
31    through  which  human tissue is cut, removed, burned, frozen,
32    vaporized, or destroyed  by  use  of  any  mechanical  means,
33    laser, energy, chemical process, radiation, or penetration of
34    tissue  or  body orifices, or (c) a procedure consistent with

 1    this definition that is determined to be surgery or operative
 2    surgery by the Medical Licensing Board by rule.   Nothing  in
 3    the  definition  shall be construed to prohibit procedures or
 4    services authorized under the Illinois Dental Practice Act or
 5    the Podiatric Medical Practice Act of 1987.

 7        Section 99.  Effective date.  This Act takes effect  upon
 8    becoming law.
