 1        AN ACT relating to transportation.

 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:

 4        Section  5.   The  Illinois  Highway  Code  is amended by
 5    changing Section 2-101 as follows:

 6        (605 ILCS 5/2-101) (from Ch. 121, par. 2-101)
 7        Sec. 2-101.  State highway system.
 8        The State highway system  includes  the  following  rural
 9    highways  together  with  their  municipal  extensions except
10    those not designated by a State highway route number and  for
11    which  an  agreement  initiated by a local authority has been
12    executed between  the  Department  and  the  local  authority
13    providing for other jurisdictional responsibility:
14        (a)  Highways constructed under the provisions of "An Act
15    in relation to the construction by the State of Illinois of a
16    state-wide  system of durable hard surfaced roads upon public
17    highways, of the State and the provision  of  means  for  the
18    payment of the cost thereof by an issue of bonds of the State
19    of   Illinois",   approved  June  22,  1917,  and  under  the
20    provisions of "An Act in relation to the construction by  the
21    State of Illinois, of durable hard surfaced roads upon public
22    highways  of  the  State  along  designated  routes,  and the
23    provision of means for the payment of the cost thereof by  an
24    issue  of  bonds of the State of Illinois", approved June 29,
25    1923;
26        (b)  Highways constructed by the  State  as  federal  aid
27    interstate highways or federal aid primary highways under the
28    provisions  of  "An  Act  in relation to the construction and
29    maintenance of Federal-aid roads under and in accordance with
30    an Act of Congress entitled, 'An  Act  to  provide  that  the
31    United  States  shall  aid  the states in the construction of

 1    rural post roads, and for other purposes', approved July  11,
 2    1916, and known as the Federal Aid Road Act, as heretofore or
 3    hereafter  amended  by  Congress  and  all  Acts supplemental
 4    thereto", approved June 27, 1917, as amended.
 5        (c)  Highways  constructed  as  federal   aid   secondary
 6    highways  under  the  provisions of Section 11a of "An Act in
 7    relation to State  highways",  approved  June  24,  1921,  as
 8    amended,  and  for  which  maintenance responsibility has not
 9    been delegated to a county pursuant to an  agreement  between
10    the Department and a county under the provisions of that Act.
11        (d)  Highways  constructed  as  State aid roads under the
12    provisions of "An Act to revise the law in relation to  roads
13    and  bridges",  approved  June  27,  1913,  as  amended,  and
14    accepted   by   the  Department  for  maintenance  under  the
15    provisions of Section 32 of that Act;
16        (e)  Highways constructed under the provisions of Section
17    9 of the "Motor Fuel Tax Law", approved March  25,  1929,  as
18    amended,  which  the  Department  was directed to maintain by
19    such Section 9;
20        (f)  Highways constructed by  the  Department  under  the
21    provisions  of  authority  granted  by any Act of the General
22    Assembly prior to the effective date of this Code;
23        (g)  Highways on which construction  is  completed  after
24    the   effective  date  of  this  Code  and  which  under  the
25    provisions of this Code become a part of the  State  highways
26    system;
27        (h)  Highways added to the State Highway system under the
28    provisions of this Code.
