1 AN ACT to amend the Election Code by adding Section
2 29-19.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Election Code is amended by adding
6 Section 29-19.5 as follows:
7 (10 ILCS 5/29-19.5 new)
8 Sec. 29-19.5. Campaign materials; false or misleading
9 information. Any pamphlet, circular, handbill, advertisement,
10 or other political literature or campaign material that is
11 published, circulated, or distributed on behalf of a person
12 who is a candidate for an office, but who does not then hold
13 that office, (1) must clearly state that the person is a
14 "candidate" for that office whenever the name of the office
15 is mentioned and (2) may not give false or misleading
16 information regarding a candidate's status as an elected
17 official. Any person who violates this Section is guilty of
18 a Class A misdemeanor.
