 1        AN  ACT  to  amend  the  Unemployment  Insurance  Act  by
 2    changing Section 227.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:


 5        Section 5. The Unemployment Insurance Act is  amended  by
 6    changing Section 227 as follows:

 7        (820 ILCS 405/227) (from Ch. 48, par. 337)
 8        Sec. 227. A. The term "employment" shall not include:
 9             1.  service  performed  after  1971 by an individual
10        who is enrolled at  a  nonprofit  or  public  educational
11        institution,  which  normally maintains a regular faculty
12        and curriculum and normally  has  a  regularly  organized
13        body  of  students  in  attendance at the place where its
14        educational activities are carried on, as a student in  a
15        full-time  program, taken for credit at such institution,
16        which combines academic instruction with work experience,
17        if such service is an integral part of such program,  and
18        such institution has so certified to the employer, except
19        that  this  paragraph  Section shall not apply to service
20        performed in a program established for or on behalf of an
21        employer or group of employers; or.
22             2.  service performed after 1998 by an individual as
23        a work-based learning experience where (i) the experience
24        is  offered  by  a  nonprofit   or   public   educational
25        institution, or combination of such  institutions, on the
26        condition  that  the institution or institutions normally
27        maintain a regular faculty  and curriculum  and  normally
28        have a regularly organized body of students in attendance
29        where    their  educational activities are carried on and
30        (ii) the institution or  institutions  certify  that  the

 1        experience  is  offered  as an integral part of a program
 2        which  combines   academic   instruction   with      work
 3        experience,   regardless  of  whether  the  services  are
 4        performed during or between academic  years or  terms  or
 5        prior  or  subsequent  to  or  contemporaneously with the
 6        classroom component of  the program.
 7        B.  Paragraph  2  of  subsection  A  does  not  apply  to
 8    services that are required to be covered as a   condition  of
 9    approval  of this Act by the United States Secretary of Labor
10    under Section  3304(a)(6)(A) of the Federal Unemployment  Tax
11    Act.
