 1        AN ACT to amend the Illinois  Vehicle  Code  by  changing
 2    Section 1-111.1a.

 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:

 5        Section 5.  The  Illinois  Vehicle  Code  is  amended  by
 6    changing Section 1-111.1a as follows:

 7        (625 ILCS 5/1-111.1a) (from Ch. 95 1/2, par. 1-171.01)
 8        Sec. 1-111.1a.  Charitable vehicle.
 9        (a)  Any  vehicle  that is exclusively owned and operated
10    by a religious or charitable not-for-profit organization  and
11    is  used  primarily  in conducting the official activities of
12    such organization.
13        (b)  This definition does not include:
14             (1)  a bus operated by a public  utility,  municipal
15        corporation or common carrier authorized to conduct local
16        or  interurban transportation of passengers when such bus
17        is on a regularly scheduled route for the  transportation
18        of  other  fare  paying  passengers or furnishing charter
19        service for the transportation of groups on special trips
20        or in connection with  special  events  and  not  over  a
21        regular or customary religious organization bus route;
22             (2)  a  school  bus  as  defined in Section 1-182 of
23        this Code; or
24             (3)  a  First  Division  vehicle,  other  than   one
25        designed  for  transporting not less than 7 nor more than
26        10 passengers, as defined in Section 1-217 of this  Code;
27        except  that  for  purposes  of determining the number of
28        persons a vehicle is designed to carry,  in  any  vehicle
29        equipped  with  one  or  more  wheelchair  tiedowns, each
30        wheelchair tiedown shall be counted as 4 persons.
