 1                     AMENDMENT TO HOUSE BILL 216

 2        AMENDMENT NO.     .  Amend House Bill 216 as follows:

 3    by replacing the title with the following:
 4        "AN ACT to amend the Wildlife code  by  changing  Section
 5    3.8."; and

 6    by  replacing  everything  after the enacting clause with the
 7    following:

 8        "Section 5.  The Wildlife Code  is  amended  by  changing
 9    Section 3.8 as follows:

10        (520 ILCS 5/3.8) (from Ch. 61, par. 3.8)
11        Sec. 3.8.  Migratory waterfowl areas; geese.
12        (a)  On any property operated under a Migratory Waterfowl
13    Hunting  Area  Permit (Commercial) where the principal use is
14    to take wild geese, it is the permit holder's duty to  ensure
15    all of the following but only during Canada goose season:
16             (1)  That  no  person takes wild geese except from a
17        blind or pit.
18             (2)  That no person establishes or uses any blind or
19        pit for the taking of wild geese within 200 yards of  any
20        other blind or pit or within 100 yards of the boundary of
21        the property on which the blind or pit is located.

 1             (3)  That no person establishes or uses any blind or
 2        pit  for the taking of wild geese within 200 yards of any
 3        wildlife refuge  boundary  or  public  road  right-of-way
 4        adjacent to any State or Federal waterfowl refuge.   If a
 5        blind  or pit has been established for more than 10 years
 6        and it  was  believed  by  both  the  landowner  and  the
 7        Department  during  that time to meet the minimum yardage
 8        requirements of this paragraph (3), then the blind or pit
 9        may remain  in  place  even  though  a  survey  or  other
10        evidence   may   indicate   that   the   minimum  yardage
11        requirements are not met.
12        (b)  On any property where the principal use is  to  take
13    wild  geese in Alexander, Franklin, Jackson, Jefferson, Union
14    and Williamson Counties, other than property operated under a
15    Migratory Waterfowl Hunting Area Permit (Commercial), all  of
16    the  following restrictions shall be observed but only during
17    Canada goose season:
18             (1)  No person may take wild  geese  except  from  a
19        blind  or  pit and it shall be illegal to take or attempt
20        to take geese from the base  of  standing  timber  except
21        when immediately adjacent to an open field.
22             (2)  No  person  may establish or use a blind or pit
23        within 100 yards of the boundary of the property on which
24        the blind or pit is located unless  the  minimum  yardage
25        requirement cannot be met, in which case one pit or blind
26        may  be permitted only if there is a minimum of 200 yards
27        between that pit or blind and the nearest pit or blind.
28             (3)  No person may establish or use a blind  or  pit
29        for  the  taking  of  wild  geese within 200 yards of any
30        wildlife refuge  boundary  or  public  road  right-of-way
31        adjacent to any State or Federal waterfowl refuge.   If a
32        blind  or pit has been established for more than 10 years
33        and it  was  believed  by  both  the  landowner  and  the
34        Department  during  that time to meet the minimum yardage

 1        requirements of this paragraph (3), then the blind or pit
 2        may remain  in  place  even  though  a  survey  or  other
 3        evidence   may   indicate   that   the   minimum  yardage
 4        requirements are not met.
 5             (4)  No more than the number of persons  allowed  by
 6        administrative  rule  may  occupy or attempt to take wild
 7        geese from any blind or pit at the same time.

 9        Section 99.  Effective date.  This Act takes effect  upon
10    becoming law.".
