 1                     AMENDMENT TO HOUSE BILL 182

 2        AMENDMENT NO.     .  Amend House Bill 182, AS AMENDED, by
 3    replacing the title with the following:
 4        "AN ACT to amend  certain  Acts  in  relation  to  mental
 5    health."; and

 6    by  inserting  immediately  after  the  enacting  clause  the
 7    following:

 8        "Section  2.   The  Abused  and  Neglected Long Term Care
 9    Facility Residents Reporting Act is amended by adding Section
10    6.9 as follows:

11        (210 ILCS 30/6.9 new)
12        Sec. 6.9.  Reviews; mental health facilities. The  agency
13    designated  by the Governor under Section 1 of the Protection
14    and Advocacy for  Developmentally  Disabled  Persons  Act  is
15    authorized  to  review  abuse,  neglect,  deaths,  and  other
16    safety-related issues in mental health facilities, as defined
17    in the Mental Health and Developmental Disabilities Code, and
18    the  effectiveness  of the State's systems that address these
19    issues. To enable the agency designated by  the  Governor  to
20    fulfill  its obligations pursuant to this Section, the agency
21    shall have authority to the same extent as that  provided  to

 1    the  Inspector  General  of the Department of Human Services.
 2    Nothing in this Section limits the agency's authority as  the
 3    State's   designated  protection  and  advocacy  system.  All
 4    identifiable information in records provided pursuant to this
 5    Section shall not be further disclosed except as provided  by
 6    the    Mental    Health    and   Developmental   Disabilities
 7    Confidentiality Act. The scope  of  these  studies  shall  be
 8    based  on the available appropriation. The Auditor General is
 9    authorized to contract with  the  agency  designated  by  the
10    Governor  for the performance of the reviews. Nothing in this
11    Section prevents the agency designated by the  Governor  from
12    securing  other  public or private funds to carry out studies
13    pursuant to this Section. The agency shall provide an  annual
14    report to the General Assembly and the Governor no later than
15    April 1 of each year regarding the reviews authorized by this
16    Section.".
