VEH CD-DRIV ABSTRACT-DUI DWLS                                              

Synopsis of Bill as introduced:
        Amends  the  Illinois  Vehicle  Code  to  provide  that  for  any      
   prosecution for violating aggravated driving under  the  influence  of      
   alcohol  or  drugs  provisions  or driving while a license, permit, or      
   privilege to operate a vehicle is suspended or revoked  provisions,  a      
   certified  copy  of  the  driving  abstract  of the defendant shall be      
   admitted as proof of any prior conviction. Effective immediately.           
        HOUSE AMENDMENT NO. 1.                                                 
          Adds reference to:                                                   
          625 ILCS 5/2-123                from Ch. 95 1/2, par. 2-123          
        Further amends the Vehicle Code.   Provides  that  any  certified      
   abstract   issued   by   the   Secretary   of   State  or  transmitted      
   electronically by the Secretary (instead of any abstract issued by the      
   Secretary), pursuant to the Section of the Vehicle Code concerning the      
   sale and distribution of information, to a court or on  request  of  a      
   law  enforcement  agency  for  the  record of a named person as to the      
   status of the person's driver's license shall be prima facie  evidence      
   of the facts stated in the abstract and if the name in the abstract is      
   the  same  as that of a person named in an information or warrant, the      
   abstract shall be prima facie evidence that the person  named  is  the      
   same  person.    Adds  that if the name in the abstract is the same as      
   that of a person named in an  information  or  warrant,  the  abstract      
   shall  also  be  admissible for any prosecution under the Vehicle Code      
   and be admitted as proof of any prior conviction or proof of  records,      
   notices, or orders recorded on the driving records.
