1 AN ACT to amend the Criminal Code of 1961 by changing
2 Section 24-1.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Criminal Code of 1961 is amended by
6 changing Section 24-1.5 as follows:
7 (720 ILCS 5/24-1.5)
8 Sec. 24-1.5. Reckless discharge of a firearm.
9 (a) A person commits reckless discharge of a firearm by
10 discharging a firearm in a reckless manner that which
11 endangers the bodily safety of an individual.
12 (b) If the conduct described in subsection (a) is
13 committed by a passenger of a moving motor vehicle with the
14 knowledge and consent of the driver of the motor vehicle the
15 driver is accountable for such conduct.
16 (c) Reckless discharge of a firearm is a Class 4 felony.
17 (d) This Section does not apply to a peace officer while
18 in the performance of his or her official duties.
