      415 ILCS 120/27 new
          Amends  the  Alternate  Fuels  Act.   Provides  that  the
      Environmental Protection Agency shall establish a program  of
      matching  grants  to  retailers  of  E85  blend  fuel for the
      installation of tanks for E85 blend fuel.  Provides that  the
      grant  shall  be  for  the  lesser  of  50%  of  the  cost of
      installation or $20,000.    Authorizes  the  Agency  to  make
      grants  to  not  more than 20 retailers beginning with fiscal
      year 2000  and  ending  with  fiscal  year  2002.   Effective
      immediately.

 1        AN  ACT  to  amend  the  Alternate  Fuels Act by changing
 2    Section 10 and adding Section 27.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Alternate  Fuels  Act  is  amended  by
 6    changing Section 10 and adding Section 27 as follows:
 7        (415 ILCS 120/10)
 8        Sec. 10.  Definitions.  As used in this Act:
 9        "Agency" means the Environmental Protection Agency.
10        "Alternate fuel" means liquid petroleum gas, natural gas,
11    E85  blend  fuel,  fuel  composed  of  a minimum 80% ethanol,
12    bio-based  methanol,    fuels  derived   from   biomass,   or
13    electricity.
14        "Alternate  fuel  vehicle"  means  any  vehicle  that  is
15    operated  in  Illinois  and  is capable of using an alternate
16    fuel.
17        "Conventional", when used to modify the  word  "vehicle",
18    "engine",   or  "fuel",  means  gasoline  or  diesel  or  any
19    reformulations of those fuels.
20        "Covered Area" means the counties of Cook, DuPage,  Kane,
21    Lake,  McHenry,  and  Will  and the townships of AuxSable and
22    Goose Lake in Grundy County and the  township  of  Oswego  in
23    Kendall County.
24        "Director"   means  the  Director  of  the  Environmental
25    Protection Agency.
26        "Domestic renewable fuel" means a fuel, produced  in  the
27    United  States,  composed of a minimum 80% ethanol, bio-based
28    methanol, and fuels derived from bio-mass.
29        "E85 blend fuel" means fuel that contains 85% ethanol and
30    15% gasoline.
31        "GVWR" means Gross Vehicle Weight Rating.

 1        "Location" means (i) a parcel of real  property  or  (ii)
 2    multiple,  contiguous  parcels  of  real  property  that  are
 3    separated    by private roadways, public roadways, or private
 4    or public rights-of-way and are owned, operated,  leased,  or
 5    under common control of one party.
 6        "Original   equipment  manufacturer"  or  "OEM"  means  a
 7    manufacturer of alternate fuel vehicles or a manufacturer  or
 8    remanufacturer  of  alternate  fuel  engines used in vehicles
 9    greater than 8500 pounds GVWR.
10        "Rental vehicle" means any motor vehicle that is owned or
11    controlled primarily for the purpose of short-term leasing or
12    rental pursuant to a contract.

15        Sec. 27.  E85 refueling retail site  program.   Beginning
16    in  fiscal  year  2000, the Agency shall operate a program to
17    provide  incentives  for  the  establishment  of  retail  E85
18    refueling sites.  Subject to appropriation, the Agency  shall
19    provide  matching  grants  to retailers of E85 blend fuel for
20    the cost of installation of tanks for E85  blend  fuel.   The
21    amount  of  the grant may not exceed 50% of the total cost of
22    installation or $20,000.  The  Agency  may  provide  matching
23    grants for not more than 20 retail locations each fiscal year
24    beginning  in  fiscal  year  2000 and ending with fiscal year
25    2002. At least 10 of the grants made each year  shall  be  to
26    retail locations situated in the covered area.
27        Section  99.  Effective date.  This Act takes effect upon
28    becoming law.
