Amends the Cannabis Control Act. Increases the penalties
by one classification for delivery of cannabis in a school,
on the real property comprising a school, on a public way
within 1,000 feet of the real property comprising a school,
or on a conveyance owned, leased, or contracted by a school
to transport students to or from school or a school related
activity.

1 AN ACT to amend the Cannabis Control Act by changing
2 Section 5.2.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Cannabis Control Act is amended by
6 changing Section 5.2 as follows:
7 (720 ILCS 550/5.2) (from Ch. 56 1/2, par. 705.2)
8 Sec. 5.2. Delivery of cannabis on school grounds.
9 (a) Any person who violates subsection (e) of Section 5
10 in any school, on the real property comprising any school, or
11 any conveyance owned, leased or contracted by a school to
12 transport students to or from school or a school related
13 activity, or on any public way within 1,000 feet of the real
14 property comprising any school, or any conveyance owned,
15 leased or contracted by a school to transport students to or
16 from school or a school related activity, is guilty of a
17 Class X 1 felony, the fine for which shall not exceed
18 $200,000;
19 (b) Any person who violates subsection (d) of Section 5
20 in any school, on the real property comprising any school, or
21 any conveyance owned, leased or contracted by a school to
22 transport students to or from school or a school related
23 activity, or on any public way within 1,000 feet of the real
24 property comprising any school, or any conveyance owned,
25 leased or contracted by a school to transport students to or
26 from school or a school related activity, is guilty of a
27 Class 1 2 felony, the fine for which shall not exceed
28 $100,000;
29 (c) Any person who violates subsection (c) of Section 5
30 in any school, on the real property comprising any school, or
31 any conveyance owned, leased or contracted by a school to

1 transport students to or from school or a school related
2 activity, or on any public way within 1,000 feet of the real
3 property comprising any school, or any conveyance owned,
4 leased or contracted by a school to transport students to or
5 from school or a school related activity, is guilty of a
6 Class 2 3 felony, the fine for which shall not exceed
7 $50,000;
8 (d) Any person who violates subsection (b) of Section 5
9 in any school, on the real property comprising any school, or
10 any conveyance owned, leased or contracted by a school to
11 transport students to or from school or a school related
12 activity, or on any public way within 1,000 feet of the real
13 property comprising any school, or any conveyance owned,
14 leased or contracted by a school to transport students to or
15 from school or a school related activity, is guilty of a
16 Class 3 4 felony, the fine for which shall not exceed
17 $25,000;
18 (e) Any person who violates subsection (a) of Section 5
19 in any school, on the real property comprising any school, or
20 any conveyance owned, leased or contracted by a school to
21 transport students to or from school or a school related
22 activity, on any public way within 1,000 feet of the real
23 property comprising any school, or any conveyance owned,
24 leased or contracted by a school to transport students to or
25 from school or a school related activity, is guilty of a
26 Class 4 felony A misdemeanor.
