          Amends the Metropolitan Water Reclamation  District  Act.
      Enlarges  the  District  to  include  the described tracts of
      land.  Effective immediately.

 1        AN  ACT  to  amend  the  Metropolitan  Water  Reclamation
 2    District Act by changing Sections 4.7, 4.11, and 5.9  and  by
 3    adding Section 271.
 4        Be  it  enacted  by  the People of the State of Illinois,
 5    represented in the General Assembly:
 6        Section 5.  The Metropolitan Water  Reclamation  District
 7    Act is amended by changing Sections 4.7, 4.11, and 5.9 and by
 8    adding Section 271 as follows:
 9        (70 ILCS 2605/4.7) (from Ch. 42, par. 323.7)
10        Sec.  4.7.   All applicants for offices or places in said
11    classified civil service, except for the positions of  deputy
12    chief  engineer,    assistant chief engineers, head assistant
13    attorneys, assistant director of  research  and  development,
14    assistant  director  of  information technology, comptroller,
15    assistant treasurer, assistant purchasing agent and  laborers
16    shall  be subjected to examination, which shall be public and
17    competitive with limitations specified in the  rules  of  the
18    Director  as  to  residence,  age, sex, health, habits, moral
19    character and qualifications to perform  the  duties  of  the
20    office  or  place to be filled, which qualifications shall be
21    prescribed in advance of such examination.  Such examinations
22    shall be practical in their character, and  shall  relate  to
23    those matters which will fairly test the relative capacity of
24    the  persons examined to discharge the duties of the position
25    to which they seek to be appointed, and may include tests  of
26    physical  qualifications  and health and when appropriate, of
27    manual skill. No question in any examination shall relate  to
28    political   or   religious  opinions  or  affiliations.   The
29    Director shall control all examinations, and may, whenever an
30    examination is to take place, designate a suitable number  of
31    persons  to  be special examiners and it shall be the duty of

 1    such special examiners to conduct such  examinations  as  the
 2    Director may direct, and to make return and report thereof to
 3    him;  and  he  may at any time substitute any other person in
 4    the place of any one so selected; and he may himself, at  any
 5    time,  act  as  such special examiner, and without appointing
 6    other  special  examiners.   The  Director  shall,  by  rule,
 7    provide for and shall hold sufficient number of  examinations
 8    to  provide  a sufficient number of eligibles on the register
 9    for each grade of position in the classified  civil  service,
10    and if any place in the classified civil service shall become
11    vacant, to which there is no person eligible for appointment,
12    he shall hold an examination for such position and repeat the
13    same,  if  necessary, until a vacancy is filled in accordance
14    with the provisions of this Act.
15        Eligible registers shall remain in  force  for  3  years,
16    except  the eligible register for laborers which shall remain
17    in force for 4 years and except the  eligible  registers  for
18    student programs and entry level engineering positions which,
19    in  the  Director's  discretion,  may remain in force for one
20    year.
21        Examinations for an eligible list for  each  position  in
22    the classified service above mentioned shall be held at least
23    once  in  3  years and at least annually for student programs
24    and entry level engineering positions  if  the  Director  has
25    limited  the duration of the registers for those positions to
26    one  year,  unless  the   Director   determines   that   such
27    examinations are not necessary because no vacancy exists.
28        To  help  defray  expenses  of examinations, the sanitary
29    district may, but need not, charge a fee  to  each  applicant
30    who  desires to take a civil service examination provided for
31    by this Act. The amount of such fees  shall  be  set  by  the
32    corporate  authority  of  the  sanitary  district.  Such fees
33    shall be deposited in the corporate fund of the district.

 2        Sec. 4.11.  Whenever a position classified under this Act
 3    is to  be  filled,  except  the  positions  of  deputy  chief
 4    engineer,   assistant   chief   engineers,   head   assistant
 5    attorneys,  assistant  director  of research and development,
 6    assistant director of  information  technology,  comptroller,
 7    assistant  treasurer, assistant purchasing agent and laborers
 8    the  appointing  officer  shall  make  requisition  upon  the
 9    Director, and the Director shall  certify  to  him  from  the
10    register   of  eligibles  for  the  position  the  names  and
11    addresses (a) of the five candidates  standing  highest  upon
12    the  register  of  eligibles  for the position, or (b) of the
13    candidates within the highest ranking group upon the register
14    of eligibles  if  the  register  is  by  categories  such  as
15    excellent,  well qualified, and qualified, provided, however,
16    that any certification shall consist of at least 5 names,  if
17    available.  The  Director shall certify names from succeeding
18    categories in the order of excellence of the categories until
19    at least 5 names are provided to the appointing officer.  The
20    appointing officer shall notify the Director of each position
21    to be filled  separately  and  shall  fill  the  position  by
22    appointment  of  one  of  the persons certified to him by the
23    Director.   Appointments shall be on probation for  a  period
24    to  be  fixed  by  the rules, not exceeding one year.  At any
25    time during the period of probation, the  appointing  officer
26    with  the  approval of the Director may discharge a person so
27    certified and shall forthwith notify the civil service  board
28    in writing of this discharge.  If a person is not discharged,
29    his appointment shall be deemed complete.
30        When  there  is  no eligible list, the appointing officer
31    may, with the authority of the  Director,  make  a  temporary
32    appointment  to  remain  in  force  only  until  a  permanent
33    appointment  from an eligible register or list can be made in
34    the manner specified  in  the  previous  provisions  of  this

 1    Section, and examinations to supply an eligible list therefor
 2    shall  be  held  and  an  eligible list established therefrom
 3    within one year from the  making  of  such  appointment.   In
 4    employment of an essentially temporary and transitory nature,
 5    the  appointing  officer  may,  with  the  authority  of  the
 6    Director  of  Personnel make temporary appointments to fill a
 7    vacancy.   No  temporary  appointment   of   an   essentially
 8    temporary  and  transitory nature may be granted for a period
 9    of more than 120 days and is not  subject  to  renewal.   The
10    Director  must  include in his annual report, and if required
11    by the commissioners, in any special report, a  statement  of
12    all  temporary  authorities granted during the year or period
13    specified by the commissioners, together with a statement  of
14    the  facts  in  each  case because of which the authority was
15    granted.
16        The acceptance or refusal by  an  eligible  person  of  a
17    temporary  appointment  does  not  affect his standing on the
18    register for permanent appointment.
19        All  laborers  shall  be   appointed   by   the   General
20    Superintendent  and  shall be on probation for a period to be
21    fixed by the rules, not exceeding one year.
22        The deputy chief engineer, the assistant chief engineers,
23    head assistant attorneys, assistant director of research  and
24    development,  assistant  director  of information technology,
25    comptroller, assistant  treasurer  and  assistant  purchasing
26    agent  shall  be appointed by the General Superintendent upon
27    the recommendation of  the  respective  department  head  and
28    shall  be on probation for a period to be fixed by the rules,
29    not exceeding two years.  At any time during  the  period  of
30    probation,  the  General Superintendent on the recommendation
31    of  the department head concerned, may discharge a person  so
32    appointed  and  he  shall  forthwith notify the Civil Service
33    Board in writing of such discharge.  If a person  is  not  so
34    discharged,  his  appointment  shall be deemed complete under

 1    the laws governing the classified civil service.

 4        Sec. 5.9. The board of trustees shall, at any time  after
 5    March 1 of each fiscal year, have power, by a two-thirds vote
 6    of  all  the members of such body, to authorize the making of
 7    transfers within a department or between departments of  sums
 8    of money appropriated for one corporate object or function to
 9    another  corporate object or function. Any such action by the
10    board of trustees shall be entered in the proceedings of  the
11    board.  No  appropriation for any object or function shall be
12    reduced below an amount sufficient to cover all  unliquidated
13    and  outstanding  contracts  or obligations certified from or
14    against the appropriation for such purpose.
15        The board of trustees, by a two-thirds vote  of  all  its
16    members,  may  transfer  the interest earned on any moneys of
17    the district into the district's fund or funds that are  most
18    in  need  of  the  interest  income.  This authority does not
19    apply to any interest that has been earmarked  or  restricted
20    by  the  board for a designated purpose.  This authority does
21    not apply to any interest earned on any funds for purposes of
22    the Metropolitan Water Reclamation District  Retirement  Fund
23    or Reserve Claim Fund.

26        Sec. 271.  District enlarged.  Upon the effective date of
27    this  amendatory  Act  of  1998,  the corporate limits of the
28    Metropolitan  Water  Reclamation  District  are  extended  to
29    include within those limits the following described tracts of
30    land that are annexed to the District:

 6        in the South Quarter  of  Section  Thirty-five,  Township

 8        Meridian in Cook County, Illinois, pursuant to a Plat  of
