720 ILCS 5/12.5-10 new
Amends the Criminal Code of 1961. Provides that it is a
Class A misdemeanor for a business that makes deliveries to
fail to deliver to specific locations because of the actual
or perceived race, color, creed, religion, ancestry, sex,
sexual orientation, physical or mental disability or national
origin of residents of that location. Penalty is a Class A
misdemeanor.

1 AN ACT to amend the Criminal Code of 1961 by adding
2 Article 12.5.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Criminal Code of 1961 is amended by
6 adding Article 12.5 as follows:
7 (720 ILCS 5/Art. 12.5 heading new)
8 ARTICLE 12.5. DELIVERY SERVICES
9 (720 ILCS 5/12.5-5 new)
10 Sec. 12.5-5. Definition. In this Article, "delivery
11 service" means a business that delivers goods or services as
12 part of its business operation.

14 Sec. 12.5-10. Delivery service; failure to deliver.
15 (a) It is unlawful for a delivery service to fail to
16 deliver to specified locations because of the actual or
17 perceived race, color, creed, religion, ancestry, sex, sexual
18 orientation, physical or mental disability, or national
19 origin of residents of that location.
20 (b) Sentence. A violation of this Section is a Class A
21 misdemeanor.
