          Amends the Illinois Dental Practice  Act.  Provides  that
      the Department of Professional Regulation shall not conduct a
      random audit of more than 10% of licensed dentists and dental
      hygienists   in  any  one  year  to  verify  compliance  with
      continuing education requirements.  Provides  that  all  fees
      necessary  for  the  administration  of  the  Act, other than
      certain license renewal fees, shall be set by the  Department
      by rule. Effective January 1, 1998.

 1        AN  ACT  to  amend  the  Illinois  Dental Practice Act by
 2    changing Sections 16.1 and 21.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section 5. The Illinois Dental Practice Act is amended by
 6    changing Sections 16.1 and 21 as follows:
 7        (225 ILCS 25/16.1) (from Ch. 111, par. 2316.1)
 8        Sec.  16.1.   Continuing education.  The Department shall
 9    promulgate rules of continuing education for persons licensed
10    under this Act.  In establishing rules, the Department  shall
11    require  a  minimum  of 32 hours of study in approved courses
12    for dentists during  each  2  year  licensing  period  and  a
13    minimum  of  24 hours of study in approved courses for dental
14    hygienists  during  each  2  year  licensing  period.   These
15    continuing education  rules  shall  only  apply  to  licenses
16    renewed after November 1, 1992.
17        The  Department  shall  approve  only  courses  that  are
18    relevant  to  the  treatment and care of patients, including,
19    but not limited to, clinical courses in dentistry and  dental
20    hygiene  and  nonclinical courses such as patient management,
21    legal and ethical responsibilities,  and  stress  management.
22    Courses  shall not be approved in such subjects as estate and
23    financial  planning,   investments,   or   personal   health.
24    Approved  courses  may  include, but shall not be limited to,
25    courses that are offered or sponsored by  approved  colleges,
26    universities,  and  hospitals  and  by  recognized  national,
27    State, and local dental and dental hygiene organizations.
28        No   license   shall   be   renewed  unless  the  renewal
29    application is accompanied by an  affidavit  indicating  that
30    the  applicant  has  completed the required minimum number of
31    hours of continuing education in approved courses as required

 1    by this Section.   The affidavit shall not require a  listing
 2    of  courses.  The  affidavit  shall be a prima facie evidence
 3    that  the  applicant  has  obtained  the  minimum  number  of
 4    required continuing education hours in approved courses.  The
 5    Department shall not be obligated to conduct random audits or
 6    otherwise  independently verify that an applicant has met the
 7    continuing education requirement.  The  Department,  however,
 8    may  not  conduct  random  audits  of  more  than  10% of the
 9    licensed dentists and dental hygienists in any one  licensing
10    cycle   to   verify   compliance  with  continuing  education
11    requirements.  If  the  Department,   however,   receives   a
12    complaint  that  a  licensee  has  not completed the required
13    continuing education or if the  Department  is  investigating
14    another  alleged  violation  of  this  Act by a licensee, the
15    Department may  demand  and  shall  be  entitled  to  receive
16    specific evidence from any licensee of completion of required
17    continuing  education courses for the most recently completed
18    2 year licensing period. Evidence of continuing education may
19    include, but is not limited  to,  canceled  checks,  official
20    verification  forms  of  attendance, and continuing education
21    recording forms, that  demonstrate  a  reasonable  record  of
22    attendance.  The  Illinois  State  Board  of  Dentistry shall
23    determine,  in  accordance  with   rules   adopted   by   the
24    Department,  whether  a  licensee  or  applicant  has met the
25    continuing education requirements. Any dentist who holds more
26    than one license under this Act shall be required to complete
27    only the minimum number  of  hours  of  continuing  education
28    required for renewal of a single license.  The Department may
29    provide  exemptions  from  continuing education requirements.
30    The exemptions shall include, but shall not  be  limited  to,
31    dentists  and  dental  hygienists  who  agree not to practice
32    within the State during the licensing period because they are
33    retired from practice.

 2        Sec. 21.  Fees. The Department is  authorized  to  impose
 3    the following nonrefundable fees:
 4        (a)  License as dentist or specialist.
 5             (1)  Application    for    temporary   training   or
 6        restricted faculty license: $25.
 7             (2)  Application for  initial  license  pursuant  to
 8        examination: $25.
 9             (3)  Applicants   for   any   examination  shall  be
10        required to pay, either  to  the  Department  or  to  the
11        designated  testing  service,  a fee covering the cost of
12        initial screening to determine eligibility and  providing
13        the examination.
14             (4)  Application   for   licensure   from  a  person
15        licensed as a dentist under the laws of another state  or
16        territory of the United States: $50.
17             (1)  (5)  Application  for renewal of a license as a
18        dentist or specialist: $50 per year.
19             (6)  Application for restoration of a  license:  $10
20        plus payment of all lapsed renewal fees.
21             (7)  Application for inactive status: $10.
22             (8)  Application   for   restoration  from  inactive
23        status: the current renewal fee.
24             (9)  Application for restoration  after  failure  to
25        notify Department of change of address: $15, plus payment
26        of all lapsed renewal fees.
27             (10)  Application   for   an   initial   permit   to
28        administer  general  anesthesia  or  parenteral conscious
29        sedation: $25.
30             (11)  Application  for  renewal  of  a   permit   to
31        administer  general  anesthesia  or  parenteral conscious
32        sedation: $25 per year.
33        (b)  License as dental hygienist.
34             (1)  Application for  initial  license  pursuant  to

 1        examination: $25.
 2             (2)  Applicants   for   any   examination  shall  be
 3        required to pay, either  to  the  Department  or  to  the
 4        designated  testing  service,  a fee covering the cost of
 5        initial screening to determine eligibility and  providing
 6        the examination.
 7             (3)  Application  for license from a person licensed
 8        as a dental hygienist under the laws of another state  or
 9        territory of the United States: $50.
10             (2)  (4)  Application  for renewal of a license as a
11        dental hygienist: $15 per year.
12             The Department shall, in consultation with the State
13        Board of Dentistry, establish  by  rule  all  other  fees
14        necessary for the administration of this Act.
15             (5)  Application  for  restoration of a license: $10
16        plus payment of all  lapsed  renewal  fees,  but  not  to
17        exceed $85.
18             (6)  Application for inactive status: $10.
19             (7)  Application   for   restoration  from  inactive
20        status: the current renewal fee.
21        (c)  General fees.
22             (1)  Application for a duplicate license: $20.
23             (2)  Application   for   a   certification   of    a
24        registrant's record for any purpose: $20.
25             (3)  Application   to   have   the   scoring  of  an
26        examination administered by the Department  reviewed  and
27        verified:  $20,  plus  any fees charged by the applicable
28        testing service.
29             (4)  The  fee  for  a  wall  certificate  showing  a
30        license shall  be  the  actual  cost  of  producing  such
31        certificate.
32             (5)  The  fee  for  a  roster of persons licensed as
33        dentists or dental specialists or  dental  hygienists  in
34        this  State  shall be the actual cost of producing such a

 1        roster.
 2             (6)  The fee for dental licensing,  disciplinary  or
 3        investigative  records  pursuant  to a subpoena is $1 per
 4        page.

 6        Section 99.   Effective  date.   This  Act  takes  effect
 7    January 1, 1998.
