          Amends the Boat Registration and Safety Act. Prohibits  a
      person  operating  a  watercraft  from  jumping  the  wake of
      another vessel within 150 feet.  Provides that  in  order  to
      operate  a  motorboat that has in tow a person on water skis,
      an aquaplane, or a similar device, the motorboat must have  a
      capacity  of  at  least  3  persons.  Prohibits a person in a
      motorboat from sitting on the gunwales, tops of  seat  backs,
      or  on  the decking over the bow or stern while the motorboat
      is underway.  Prohibits a  livery  from  leasing  a  personal
      watercraft  or  speciality  prop-craft  to  a person under 16
      (instead of 12) years of age.

 1        AN ACT to amend the Boat Registration and Safety  Act  by
 2    changing  Sections  5-2,  5-14,  and  7-10 and adding Section
 3    5-21.
 4        Be it enacted by the People of  the  State  of  Illinois,
 5    represented in the General Assembly:
 6        Section  5.   The  Boat  Registration  and  Safety Act is
 7    amended by changing Sections  5-2,  5-14,  and  7-10  and  by
 8    adding Section 5-21 as follows:
 9        (625 ILCS 45/5-2) (from Ch. 95 1/2, par. 315-2)
10        Sec.  5-2.  Reckless operation. No person shall operate a
11    any watercraft, specialty prop-craft, or personal  watercraft
12    or manipulate any water skis, aquaplane, or similar device in
13    such  a manner as to willfully or wantonly endanger the life,
14    limb, or property of a any person, to weave through congested
15    traffic, to jump the wake of another vessel within  150  feet
16    of the other vessel or unreasonably or unnecessarily close to
17    the  other  vessel or when visibility around the other vessel
18    is obstructed, to wait until  the  last  possible  moment  to
19    swerve to avoid collision, or operate any watercraft so as to
20    approach  or  pass  another watercraft in such a manner or at
21    such a rate of speed as to create a hazardous wake or wash.

24        Sec. 5-14.  Water Skiing. A.  No  person  may  operate  a
25    motorboat  that  which has in tow or is otherwise assisting a
26    person on water skis, an aquaplane, or a similar contrivance,
27    in or upon any waterway, unless  the  such  motorboat  has  a
28    capacity  of at least 3 persons and is occupied by at least 2
29    competent persons.
30        B.  No person may operate a motorboat having  in  tow  or

 1    otherwise  be  assisting a person on water skis, aquaplane or
 2    similar contrivance from the period of  one-half  hour  after
 3    sunset to one-half hour before sunrise. This paragraph B does
 4    not  apply  to  motorboats  used in duly authorized water ski
 5    tournaments, competitions,  exhibitions  or  trials  therefor
 6    where adequate lighting is provided.
 7        C.   All  persons  operating a motorboat having in tow or
 8    otherwise assisting a person  on  water  skis,  aquaplane  or
 9    similar  contrivance,  must  be  careful and prudent in their
10    operation and keep at a reasonable distance from persons  and
11    property  so  as  not to endanger the life or property of any
12    person.
13        D.  No person may operate or manipulate any  vessel,  tow
14    rope  or  other  device by which the direction or location of
15    water skis, aquaplane, or similar device may be  affected  or
16    controlled  in  such  a  way  as  to  cause  the  water skis,
17    aquaplane, or similar  device,  or  any  persons  thereon  to
18    collide  with  or strike against any person or object, except
19    ski  jumps,  buoys  and  like  objects   normally   used   in
20    competitive or recreational skiing.

23        Sec.  5-21.  Passenger  location.   No person operating a
24    motorboat shall allow a person in the motorboat  to  ride  or
25    sit  on  the  gunwales, tops of seat backs, or on the decking
26    over the bow or stern of the motorboat while the motorboat is
27    underway, unless the person is inboard  of  guards  or  rails
28    provided  on  the  motorboat to prevent passengers from being
29    lost overboard.
30        Nothing in this Section shall be  construed  to  prohibit
31    entry upon the decking over the bow or stern of the motorboat
32    for the purpose of anchoring, mooring, or casting off or some
33    other  necessary  purpose nor to prohibit customary practices

 1    while  lawfully  engaged  in  commercial  fishing  under  the
 2    provisions of the Fish and Aquatic Life Code or  hunting  and
 3    trapping under the provisions of the Wildlife Code.

 5        Sec.  7-10.   Unlawful  rental  of personal watercraft or
 6    specialty prop-craft.
 7        (a)  A livery shall not lease, hire or  rent  a  personal
 8    watercraft or a specialty prop-craft to, or for operation by,
 9    any person who is under 16 12 years of age.
10        (b)  Any  person  convicted  of violating this Section is
11    guilty of a Class A misdemeanor.
