          Amends the State Police Act to provide for payment of the
      burial expenses (up to  $10,000)  of  State  police  officers
      killed  in the line of duty.  Amends the State Finance Act to
      provide that these benefits  shall  be  paid  out  of  moneys
      appropriated  for personal services of State police officers.

 1        AN ACT in relation to burial expenses  for  State  police
 2    officers killed in the line of duty.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The State Police Act  is  amended  by  adding
 6    Section 12.2 as follows:
 7        (20 ILCS 2610/12.2 new)
 8        Sec.  12.2.  Burial  benefit  for  State  police officers
 9    killed in the line of duty.
10        (a)  The Department of State Police shall pay directly or
11    reimburse, up to a maximum of $10,000, the burial expenses of
12    each State police officer who is killed in the line  of  duty
13    after June 30, 1997.
14        (b)  The  payments  provided for in this Section shall be
15    paid out of moneys appropriated to  the  Department  for  the
16    personal services of State police officers.
17        (c)  The  Department  of  State  Police shall adopt rules
18    governing the administration of this Section.
19        Section 10.  The State Finance Act is amended by changing
20    Section 14 as follows:

22        Sec. 14.  The item "personal services", when used  in  an
23    appropriation  Act,  means  the reward or recompense made for
24    personal services rendered for the State  by  an  officer  or
25    employee  of  the  State or of an instrumentality thereof, or
26    for the purpose of Section 14a of this  Act,  or  any  amount
27    required  or authorized to be deducted from the salary of any
28    such person under the provisions of Section 30c of this  Act,
29    or any retirement or tax law, or both, or deductions from the

 1    salary  of any such person under the Social Security Enabling
 2    Act or deductions from the salary of such person pursuant  to
 3    the Voluntary Payroll Deductions Act of 1983.
 4        If  no  home  is furnished to a person who is a full-time
 5    chaplain employed by the State or a former full-time chaplain
 6    retired from State employment, 20% of the salary  or  pension
 7    paid to that person for his personal services to the State as
 8    chaplain  are considered to be a rental allowance paid to him
 9    to rent or otherwise provide a home. This amendatory  Act  of
10    1973  applies to State salary amounts received after December
11    31, 1973.
12        When  any  appropriation  payable  from  trust  funds  or
13    federal funds includes an item for personal services but does
14    not include  a  separate  item  for  State  contribution  for
15    employee group insurance, the State contribution for employee
16    group  insurance  in  relation  to  employees paid under that
17    personal services line item shall also be payable under  that
18    personal services line item.
19        When  any  appropriation  payable  from  trust  funds  or
20    federal funds includes an item for personal services but does
21    not   include   a   separate  item  for  employee  retirement
22    contributions paid by the employer,  the  State  contribution
23    for employee retirement contributions paid by the employer in
24    relation  to employees paid under that personal services line
25    item shall also be payable under that personal services  line
26    item.
27        The   item   "personal   services",   when   used  in  an
28    appropriation Act, shall also mean and include a payment to a
29    State retirement system by a State agency to discharge a debt
30    arising from the over-refund to  an  employee  of  retirement
31    contributions.  The  payment  to  a  State  retirement system
32    authorized by  this  paragraph  shall  not  be  construed  to
33    release  the employee from his or her obligation to return to
34    the State the amount of the over-refund.

 1        The  item  "personal   services",   when   used   in   an
 2    appropriation  Act,  also includes a payment to reimburse the
 3    Department of Central Management Services for temporary total
 4    disability benefit payments in  accordance  with  subdivision
 5    (i)(2)  of  Section  64.1 of the Civil Administrative Code of
 6    Illinois.
 7        Beginning July 1, 1993, the item "personal services"  and
 8    related line items, when used in an appropriation Act or this
 9    Act,  shall  also  mean and include back wage claims of State
10    officers and employees to the extent those  claims  have  not
11    been  satisfied  from  the  back  wage  appropriation  to the
12    Department of Central Management Services  in  the  preceding
13    fiscal  year,  as  provided  in  Section  14b of this Act and
14    Section 64.1(m) of the Civil Administrative Code of Illinois.
15        The item "personal services", when used with  respect  to
16    State  police officers in an appropriation Act, also includes
17    a payment for the burial expenses of a State  police  officer
18    killed  in  the line of duty, made in accordance with Section
19    12.2 of the State Police Act and any rules adopted under that
20    Section.

22        Section 99. Effective date.  This Act takes  effect  upon
23    becoming law.
