      215 ILCS 5/155.31 new
          Amends the Illinois  Insurance  Code.   Provides  that  a
      company  may  not cancel or refuse to issue or renew a policy
      of  homeowners  or  renters  insurance  because  the  insured
      premises are operated as a day care home or  group  day  care
      home.    Provides that losses arising out of or in connection
      with day care provided in a day care home or group  day  care
      home  may  not  be  covered  under  a  homeowners  or renters
      insurance policy.  Requires a separate policy or  endorsement
      for  which  premiums  are  assessed and paid for coverage for
      those losses.

 1        AN ACT to amend the Illinois  Insurance  Code  by  adding
 2    Sections 155.31 and 155.32.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Illinois Insurance  Code  is  amended  by
 6    adding Sections 155.31 and 155.32 as follows:
 7        (215 ILCS 5/155.31 new)
 8        Sec.   155.31.   Day  care  and  group  day  care  homes;
 9    coverage.
10        (a)  No insurer providing insurance coverage, as  defined
11    in  subsection  (b)  of  Section  143.13  of this Code, shall
12    nonrenew or cancel an insurance policy on a day care home  or
13    group  day  care  home,  as  defined in the Child Care Act of
14    1969, solely on the basis that the insured  operates  a  duly
15    licensed  day care home or group day care home on the insured
16    premises.
17        (b)  An insurer providing such insurance  coverage  to  a
18    licensed  day  care  home or licensed group day care home may
19    provide such coverage with a separate policy  or  endorsement
20    to  a  policy  of  fire  and  extended coverage insurance, as
21    defined in subsection (b) of Section 143.13.
22        (c)  Notwithstanding subsections  (a)  and  (b)  of  this
23    Section, the insurer providing such coverage shall be allowed
24    to  cancel or nonrenew an insurance policy on a day care home
25    or group day care home  based  upon  the  authority  provided
26    under Sections 143.21 and 143.21.1 of this Code.

28        Sec.  155.32.   Policy  explanations; language other than
29    English. An insurance carrier licensed to  provide  insurance
30    as  defined  in  subsections (a) and (b) of Section 143.13 of

 1    this  Code  may  provide  insurance  policies,  endorsements,
 2    riders, and any explanatory  or  advertising  material  in  a
 3    language  other  than  English.  In the event of a dispute or
 4    complaint regarding the insurance  or  advertising  material,
 5    the  English language version of the insurance coverage shall
 6    control the resolution of the dispute or complaint.
