      35 ILCS 200/27-16 new
          Amends the Special Service Area Tax Law in  the  Property
      Tax  Code.   Provides  that  a  county  may,  pursuant  to an
      intergovernmental cooperation agreement, transfer its  powers
      under  this  Law  to  a  township  when  the proposed special
      service area consists of an unincorporated area lying  solely
      within  that  township.   Provides that the township board of
      trustees shall then be the  governing  body  of  the  special
      service  area  and shall possess all of the powers the county
      possesses under this Law.  Provides that  once  the  township
      has  passed  an  ordinance  proposing  the establishment of a
      special service area, no unincorporated property  within  the
      proposed  special  service  area at the time the ordinance is
      passed shall be excluded from the the  special  service  area
      except with approval of the township board of trustees.

 1        AN  ACT  to amend the Property Tax Code by adding Section
 2    27-16.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Property Tax Code is amended by adding
 6    Section 27-16 as follows:
 7        (35 ILCS 200/27-16 new)
 8        Sec. 27-16.  Transfer  of  authority  to  township.   Any
 9    county  may,  pursuant  to  an  intergovernmental cooperation
10    agreement, transfer  its  powers  under  this  Article  to  a
11    township  when  the proposed special service area consists of
12    an unincorporated area lying  solely  within  that  township.
13    The  township  board  of trustees shall then be the governing
14    body of the special  service  area  and  shall  exercise  all
15    powers  that  the  county  possesses under this Article.  The
16    township may provide for special services  such  as  streets,
17    sidewalks, water systems, sanitary sewer systems, storm sewer
18    systems, street lighting, and alley paving in addition to all
19    other  services  the township is authorized to provide.  Once
20    the  township  has  passed   an   ordinance   proposing   the
21    establishment  of  a  special service area, no unincorporated
22    property within the proposed special service area at the time
23    the ordinance is passed shall be excluded  from  the  special
24    service  area  except with the approval of the township board
25    of trustees, even if the territory is subsequently annexed to
26    a municipality.
