1 AN ACT to amend the Public Utilities Act by changing
2 Section 7-104.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Public Utilities Act is amended by
6 changing Section 7-104 as follows:
7 (220 ILCS 5/7-104) (from Ch. 111 2/3, par. 7-104)
8 Sec. 7-104. Proceedings; standing. In a proceeding
9 before the Commission in which the consent and approval of
10 the Commission to the sale, lease or other disposition of any
11 real property owned by a public utility is sought, any tenant
12 in possession who has been in possession of such property for
13 more than 5 years and who has made substantial improvements
14 to the property has standing to appear and offer evidence to
15 the Commission with respect to the proposed disposition, and
16 the Commission, in making its determination, shall consider
17 the rights and equities of such tenant in possession.
