          Amends  the  Illinois  Banking  Act,  the  Illinois  Bank
      Holding Company Act of 1957, the Illinois  Savings  and  Loan
      Act  of  1985,  the  Savings  Bank  Act, and the Foreign Bank
      Representative  Office  Act.   Provides  that  entities   and
      employees  of  entities  organized  under  those Acts are not
      liable to persons not in privity of contract for  conduct  in
      connection with computer operations involving the rollover of
      the 2-digit date value to "00" in the year 2000.

 1        AN   ACT   concerning   computer  operations  of  certain
 2    financial institutions, amending named Acts.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Illinois Banking Act is amended by adding
 6    Section 84 as follows:
 7        (205 ILCS 5/84 new)
 8        Sec.  84.  Computer date rollover; no liability.  No bank
 9    or subsidiary of the bank shall be liable to persons  not  in
10    privity of contract with the bank or a subsidiary of the bank
11    for  civil damages resulting from acts, omissions, decisions,
12    or other  conduct  in  connection  with  computer  operations
13    involving  the  rollover of the 2-digit date value to "00" in
14    the year 2000.  No employee, officer, or director of  a  bank
15    or  subsidiary  of the bank shall be liable to any person for
16    civil damages resulting from acts, omissions,  decisions,  or
17    other   conduct   in   connection  with  computer  operations
18    involving the rollover of the 2-digit date value to  "00"  in
19    the year 2000.
20        Section  10.  The  Illinois  Bank  Holding Company Act of
21    1957 is amended by adding Section 4.5 as follows:

23        Sec. 4.5.  Computer date rollover; no liability.  No bank
24    holding company or subsidiary of  the  bank  holding  company
25    shall  be  liable  to persons not in privity of contract with
26    the bank holding company or a subsidiary of the bank  holding
27    company  for  civil  damages  resulting from acts, omissions,
28    decisions, or  other  conduct  in  connection  with  computer
29    operations  involving  the rollover of the 2-digit date value

 1    to "00" in the year 2000.  No employee, officer, or  director
 2    of  a  bank holding company or subsidiary of the bank holding
 3    company shall be liable  to  any  person  for  civil  damages
 4    resulting  from  acts, omissions, decisions, or other conduct
 5    in connection with computer operations involving the rollover
 6    of the 2-digit date value to "00" in the year 2000.
 7        Section 15.  The Illinois Savings and Loan Act of 1985 is
 8    amended by adding Section 1-13 as follows:
 9        (205 ILCS 105/1-13 new)
10        Sec. 1-13.  Computer date  rollover;  no  liability.   No
11    association  or subsidiary of the association shall be liable
12    to persons not in privity of contract with the association or
13    a subsidiary of the association for civil  damages  resulting
14    from   acts,   omissions,  decisions,  or  other  conduct  in
15    connection with computer operations involving the rollover of
16    the 2-digit  date  value  to  "00"  in  the  year  2000.   No
17    employee,   officer,   or   director  of  an  association  or
18    subsidiary of the association shall be liable to  any  person
19    for  civil damages resulting from acts, omissions, decisions,
20    or other  conduct  in  connection  with  computer  operations
21    involving  the  rollover of the 2-digit date value to "00" in
22    the year 2000.
23        Section 20.  The Savings Bank Act is  amended  by  adding
24    Section 1010 as follows:
25        (205 ILCS 205/1010 new)
26        Sec.  1010.  Computer  date  rollover;  no liability.  No
27    savings bank or subsidiary  of  the  savings  bank  shall  be
28    liable to persons not in privity of contract with the savings
29    bank  or  a  subsidiary of the savings bank for civil damages
30    resulting from acts, omissions, decisions, or  other  conduct

 1    in connection with computer operations involving the rollover
 2    of  the  2-digit  date  value  to  "00" in the year 2000.  No
 3    employee,  officer,  or  director  of  a  savings   bank   or
 4    subsidiary  of the savings bank shall be liable to any person
 5    for civil damages resulting from acts, omissions,  decisions,
 6    or  other  conduct  in  connection  with  computer operations
 7    involving the rollover of the 2-digit date value to  "00"  in
 8    the year 2000.
 9        Section  25.  The  Foreign Bank Representative Office Act
10    is amended by adding Section 9 as follows:
11        (205 ILCS 650/9 new)
12        Sec.  9.  Computer  date  rollover;  no  liability.    No
13    foreign  bank  or  subsidiary  of  the  foreign bank shall be
14    liable to persons not in privity of contract with the foreign
15    bank or a subsidiary of the foreign bank  for  civil  damages
16    resulting  from  acts, omissions, decisions, or other conduct
17    in connection with computer operations involving the rollover
18    of the 2-digit date value to  "00"  in  the  year  2000.   No
19    employee,   officer,   or  director  of  a  foreign  bank  or
20    subsidiary of the foreign bank shall be liable to any  person
21    for  civil damages resulting from acts, omissions, decisions,
22    or other  conduct  in  connection  with  computer  operations
23    involving  the  rollover of the 2-digit date value to "00" in
24    the year 2000.
