      60 ILCS 1/15-20
          Amends the Township Code.  Provides that when a city with
      a  coterminous  township  annexes  territory  that   is   not
      disconnected  from  an  adjacent  township,  a  member of the
      city's council who resides in  the  portion  of  the  annexed
      territory that is not disconnected from the adjacent township
      is  not  disqualified  from  serving  on  the  board  of  the
      coterminous  township  or  from voting on matters relating to
      the coterminous township.  Effective immediately.

 1        AN ACT to amend the Township  Code  by  changing  Section
 2    15-20.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Township  Code  is  amended  by  changing
 6    Section 15-20 as follows:
 7        (60 ILCS 1/15-20)
 8        Sec. 15-20.  Failure of proposition to disconnect; status
 9    quo.  Where the proposition to disconnect the territory fails
10    and it remains with the adjacent township, the status quo and
11    operation of a  township  and  the  officers  of  a  township
12    coterminous  with  a  city  at  the time provided for in this
13    Article is not to be  affected.   Where  the  proposition  to
14    disconnect  fails, the status quo of a council of a city that
15    is coterminous with a township at the time  provided  for  in
16    this Article and that already is vested with the authority to
17    exercise  all powers vested in that township is not affected.
18    Where a city coterminous at the time  provided  for  in  this
19    Article has provided by operation of law that certain offices
20    of  the  city and the coterminous township shall be united in
21    the same person, or that the office and election  of  highway
22    commissioners  shall  be  discontinued,  that provision shall
23    continue to be the case after the proposition  to  disconnect
24    the  territory  fails.   Where  the proposition to disconnect
25    fails, vacancies in any of the township offices in a township
26    coterminous at the time provided  for  in  this  Section  may
27    continue  to  be  filled  by  the  city  council.  Where  the
28    proposition  to disconnect fails or the city, its coterminous
29    township,   and    the    adjacent    township    agree    by
30    intergovernmental  cooperation  agreement  that the territory
31    shall remain part of the  adjacent  township,  the  city  may

 1    annex  the  territory and by doing so does not relinquish its
 2    status as a city with a coterminous township.
 3        A member of the city's council who resides in the portion
 4    of the annexed territory that is not  disconnected  from  the
 5    adjacent  township  is  not  disqualified from serving on the
 6    board of the conterminous township or from voting on  matters
 7    relating to the coterminous township.

 9        Section  99.  Effective date.  This Act takes effect upon
10    becoming law.
