      605 ILCS 5/5-701.7        from Ch. 121, par. 5-701.7
          Amends  the  Illinois  Highway   Code.    In   provisions
      regarding  the use of motor fuel tax funds, provides that any
      county board, with the approval of the Department,  may  also
      use  motor fuel tax funds allotted to it, matching tax funds,
      or any other funds of the county  for  highways  to  pay  the
      county's   proportionate  share  of  any  federally  eligible
      transportation project on, adjacent to, or intended to  serve
      county highways in the county.

 1        AN  ACT  to  amend  the Illinois Highway Code by changing
 2    Section 5-701.7.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Illinois  Highway  Code  is amended by
 6    changing Section 5-701.7 as follows:
 7        (605 ILCS 5/5-701.7) (from Ch. 121, par. 5-701.7)
 8        Sec. 5-701.7. (a) Any county board with the  approval  of
 9    the  Department may also use motor fuel tax funds allotted to
10    it to pay the county's share of the cost of projects  on  the
11    federal  aid  urban  and  the  federal  aid secondary highway
12    systems in the county constructed under the provisions of the
13    Federal Aid Road Act.  The  county  board  is  authorized  to
14    cooperate  with  the Department in selecting these systems of
15    federal aid highways to be improved.
16        (b)  Any county board with the approval of the Department
17    may also use motor fuel tax funds allotted to it to  pay  the
18    county's  share  of  any  project  constructed  under Section
19    3-104.3 of this Code.
20        (c)  Any  county  board,  with  the   approval   of   the
21    Department, may also use motor fuel tax funds allotted to it,
22    matching  tax  funds,  or  any  other funds of the county for
23    highways to pay  the  county's  proportionate  share  of  any
24    federally eligible transportation project on, adjacent to, or
25    intended to serve county highways in the county.
