      105 ILCS 5/2-3.126 new
          Amends  the  School  Code.   Creates  a  K-5  class  size
      reduction grant program to be implemented and administered by
      the State Board of Education.   Provides  for  the  award  of
      grants  by  the State Board of Education, from appropriations
      made for purposes of the program, to  school  districts  that
      maintain  grades K-5, have an average class size for any such
      grade of at least 23 pupils per  classroom  at  the  time  of
      applying  for  a grant, and agree as a condition of the grant
      to reduce the size of each classroom maintained for pupils in
      a grade with respect to which a grant is made by at  least  5
      pupils per classroom.  Provides that no grant funds are to be
      awarded to enable a district to reduce classroom size to less
      than  18  pupils.  Limits use of the grant funds to operating
      and maintaining classes in grades K-5 that meet the  criteria
      established by the grant program. Effective July 1, 1998.

 1        AN  ACT  to  amend  the  School  Code  by  adding Section
 2    2-3.126.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The School Code is amended by adding Section
 6    2-3.126 as follows:
 7        (105 ILCS 5/2-3.126 new)
 8        Sec. 2-3.126.  K-5 class size reduction grant program.  A
 9    class size reduction grant program is  hereby  created.   The
10    program  shall  be  implemented and administered by the State
11    Board  of  Education,   which   shall   award   grants   from
12    appropriations  made  for  purposes of this Section to school
13    districts that meet the criteria established by this  Section
14    for the award of those grants.
15        Grants  shall  be  awarded  pursuant to application.  The
16    form and manner of applications  and  the  criteria  for  the
17    award  of  grants  shall  be prescribed by the State Board of
18    Education.  However, the  grant  criteria  as  so  prescribed
19    shall  provide  that:  (i) only those districts that maintain
20    grades kindergarten through 5 shall  be  grant  eligible  and
21    only  with respect to such of those grades as have an average
22    class size for the grade of at least 23 pupils per  classroom
23    at  the  time  the  district applies for the grant; (ii) if a
24    district qualifies for a grant  under  item  (i),  the  grant
25    shall  be  conditioned  upon the agreement of the district to
26    reduce the size of each classroom maintained  for  pupils  in
27    the  grade  with  respect  to  which that grant is made by at
28    least 5 pupils per classroom; and (iii) no grant funds  shall
29    be  awarded to enable a district to reduce class size to less
30    than 18 pupils per classroom.
31        Grants awarded to eligible districts under  this  Section

 1    shall  be  used  and  applied  by the districts to defray the
 2    costs and expenses of operating and  maintaining  classes  in
 3    grades  kindergarten  through  5  that meet the size criteria
 4    established by this Section.
 5        The State Board  of  Education  shall  adopt  any  rules,
 6    consistent  with  the  requirements of this Section, that are
 7    necessary to implement and  administer  the  K-5  class  size
 8    reduction grant program.
 9        Section  99.  Effective date.  This Act takes effect July
10    1, 1998.
