      105 ILCS 5/27-23.5 new
          Amends the School Code.  Requires  each  school  district
      maintaining  grades 9 and 10 to include in its curriculum and
      teach to the students  of  either  such  grade  one  unit  of
      instruction   on   organ/tissue   donor  and  transplantation
      programs.  Requires the regional superintendent of schools to
      make available to those districts information and  data  that
      the  districts  may  use  in  developing the required unit of
      instruction.  Provides that each school board determines  the
      minimum  amount  of  instructional time that qualifies as the
      required unit of instruction.  Effective July 1, 1998.

 1        AN ACT  to  amend  the  School  Code  by  adding  Section
 2    27-23.5.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The School Code is amended by adding  Section
 6    27-23.5 as follows:
 7        (105 ILCS 5/27-23.5 new)
 8        Sec.  27-23.5.  Organ/tissue  donor  and  transplantation
 9    programs.   Each  school district that maintains grades 9 and
10    10 may include in its curriculum and teach to the students of
11    either such grade one unit  of  instruction  on  organ/tissue
12    donor  and  transplantation  programs.   No  student shall be
13    required  to  take   or   participate   in   instruction   on
14    organ/tissue  donor  and transplantation programs if a parent
15    or guardian files written objection thereto on constitutional
16    grounds,  and  refusal  to  take  or  participate   in   such
17    instruction   on  those  grounds  shall  not  be  reason  for
18    suspension or  expulsion  of  a  student  or  result  in  any
19    academic penalty.
20        The  regional superintendent of schools in which a school
21    district that maintains grades 9  and  10  is  located  shall
22    obtain and make available to the school board of the district
23    information  and  data  that  may  be used by the district in
24    developing  a  unit  of  instruction  under   this   Section.
25    However, each school board shall determine the minimum amount
26    of  instructional  time  that  shall  qualify  as  a  unit of
27    instruction satisfying the requirements of this Section.
28        Section 99.  Effective date.  This Act takes effect  July
29    1, 1998.
