Amends the Counties Code and the Illinois Municipal Code.
Prohibits a county or municipality to locate an adult
entertainment facility within 1,000 feet of the property
boundary of any forest preserve district. Effective

1 AN ACT concerning the location of adult entertainment
2 facilities, amending named Acts.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Counties Code is amended by changing
6 Section 5-1097.5 as follows:
7 (55 ILCS 5/5-1097.5)
8 Sec. 5-1097.5. Adult entertainment facility. It is
9 prohibited within a county to locate an adult entertainment
10 facility within 1,000 feet of the property boundaries of any
11 school, day care center, cemetery, public park, forest
12 preserve district, public housing, and place of religious
13 worship.
14 For the purposes of this Section, "adult entertainment
15 facility" means (i) a striptease club or pornographic movie
16 theatre whose business is the commercial sale, dissemination,
17 or distribution of sexually explicit material, shows, or
18 other exhibitions or (ii) an adult bookstore or adult video
19 store whose primary business is the commercial sale,
20 dissemination, or distribution of sexually explicit material,
21 shows, or other exhibitions.

23 Section 10. The Illinois Municipal Code is amended by
24 changing Section 11-5-1.5 as follows:

26 Sec. 11-5-1.5. Adult entertainment facility. It is
27 prohibited within a municipality to locate an adult
28 entertainment facility within 1,000 feet of the property
29 boundaries of any school, day care center, cemetery, public

1 park, forest preserve district, public housing, and place of
2 religious worship.
3 For the purposes of this Section, "adult entertainment
4 facility" means (i) a striptease club or pornographic movie
5 theatre whose business is the commercial sale, dissemination,
6 or distribution of sexually explicit material, shows, or
7 other exhibitions or (ii) an adult bookstore or adult video
8 store whose primary business is the commercial sale,
9 dissemination, or distribution of sexually explicit material,
10 shows, or other exhibitions.

12 Section 99. Effective date. This Act takes effect upon
13 becoming law.
