          Amends various Acts relating to  the  governance  of  the
      public  universities in Illinois.  Provides that beginning on
      the effective date of the amendatory Act and  until  July  1,
      2001 the governing board of each public university shall have
      a student member who is entitled to vote on all Board matters
      except  those involving faculty tenure, faculty promotion, or
      an issue on which that student member has a  direct  conflict
      of  interest.   Provides  that  beginning  July  1,  2001 all
      student members of the governing board of a public university
      shall be nonvoting members.  Adds that a student  member  who
      is  not entitled to vote on a measure shall not be considered
      a member for the purpose of determining whether a  quorum  is
      present  at  the  time  that  measure  is  voted  upon.  Adds
      qualifications for selection, designation, and service  as  a
      voting  or  nonvoting  student  member  of a governing Board.
      Provides that for a voting student member whose  term  begins
      on  July  1,  1998 or on July 1 of either of the 2 succeeding
      calendar years, the Governor shall designate that member from
      a  list  of  candidates  submitted  by  the  Student  Trustee
      Screening Panel.   Provides  for  the  appointment  of  Panel
      members   and   makes   other   related  changes.   Effective
      immediately.

 1        AN ACT relating to membership on the governing boards  of
 2    public universities.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The University of Illinois  Trustees  Act  is
 6    amended by changing Section 1 as follows:
 7        (110 ILCS 310/1) (from Ch. 144, par. 41)
 8        Sec.  1.   The  Board  of  Trustees  of the University of
 9    Illinois  shall  consist  of  9  trustees  appointed  by  the
10    Governor, by and with the advice and consent of  the  Senate,
11    the  Governor,  and, until July 1, 2001, one voting nonvoting
12    student member designated by the Governor from one campus  of
13    the  University  and  one  nonvoting student member from each
14    campus of  the  University  not  represented  by  the  voting
15    student  member.   The  Governor  shall  designate one of the
16    student members serving on the Board on the effective date of
17    this amendatory Act of 1997 to serve as  the  voting  student
18    member for the remainder of that student's term on the Board.
19    Beginning  on  July  1,  2001,  and  thereafter,  the student
20    members of the Board shall  all  be  nonvoting  members,  one
21    selected from each campus of the University of Illinois.
22        Each  nonvoting  student member shall serve a term of one
23    year, beginning on July 1 of each year or on the date of  his
24    or  her  selection,  whichever  is later, and expiring on the
25    next succeeding June 30.  The student members shall have  all
26    of  the privileges of membership, including the right to make
27    and second motions and to attend executive   sessions,  other
28    than  the  right  to vote, except that until July 1, 2001 the
29    student member designated  by  the  Governor  as  the  voting
30    student  member  shall  have  the  right to vote on all Board
31    matters  except  those  involving  faculty  tenure,   faculty

 1    promotion  or  any  issue  on  which the student member has a
 2    direct conflict of interest.  Until June 30, 1998, the method
 3    of selecting these student members  shall  be  determined  by
 4    campus-wide  student  referendum.   For the nonvoting student
 5    members whose terms begin on July 1, 1998, or on July 1 of  a
 6    subsequent  calendar  year,  the  method  of  selection shall
 7    continue to be determined by campus-wide student  referendum.
 8    For a voting student member whose term begins on July 1, 1998
 9    or  on  July  1 of either of the 2 succeeding calendar years,
10    the Governor shall designate the voting  student member  from
11    a  list  of  candidates  submitted  by  the  Student  Trustee
12    Screening   Panel.   The   Student  Trustee  Screening  Panel
13    consisting of 6 members shall be appointed  each  January  as
14    follows: 3 appointed by the President of the University and 3
15    selected  by  the student government. On or before March 1 of
16    each year, the Student Trustee Screening Panel shall  provide
17    the Governor with a list of 4 candidates for the position  of
18    the  voting  student  member.     A student member who is not
19    entitled to vote on a measure at a meeting of  the  Board  or
20    any  of  its  committees shall not be considered a member for
21    the purpose of determining whether a quorum is present at the
22    time that measure is voted upon.  Nonvoting  student  members
23    shall   not   be   considered  members  for  the  purpose  of
24    determining a quorum at any meeting of the Board  or  any  of
25    its  committees.   To  be eligible for selection as a student
26    member, to be eligible for designation by the Governor  as  a
27    student  member who has the right to vote, and to be eligible
28    to remain as a voting or  nonvoting  student  member  of  the
29    Board,  a  student  member  must be a resident of this State,
30    must  have  and  maintain  a  grade  point  average  that  is
31    equivalent to at least 2.5 on a 4.0 scale, and must be a full
32    time student enrolled at all times during his or her term  of
33    office  except    for that part of the term which follows the
34    completion of the last full regular semester of  an  academic

 1    year  and  precedes  the  first  full regular semester of the
 2    succeeding  academic  year  at  the   university   (sometimes
 3    commonly referred to as the summer session or summer school).
 4    If  a voting or nonvoting student member serving on the Board
 5    fails to continue to meet or maintain the residency,  minimum
 6    grade point average, or enrollment requirement established by
 7    this  Section,  his  or  her membership on the Board shall be
 8    deemed to have terminated by operation of law.
 9        The term of each elected trustee who is in office on  the
10    effective date of this amendatory Act of 1995 shall terminate
11    on  the  second  Monday in January, 1996, or when a quorum of
12    the trustees initially to be appointed under this  amendatory
13    Act  of  1995  is  appointed  and  qualified,  whichever last
14    occurs.
15        No more than 5 of the 9 trustees members appointed by the
16    Governor shall be affiliated with the same  political  party.
17    The term of office of each appointed trustee shall be 6 years
18    from  the  third Monday in January of each odd numbered year,
19    except that of the 9  trustees  initially  appointed  by  the
20    Governor, 3 shall be appointed for terms that commence on the
21    date  of their appointment and expire on the second Monday in
22    January, 1997; 3 shall be appointed for terms  that  commence
23    on  the  date  of  their appointment and expire on the second
24    Monday in January, 1999; and 3 shall be appointed  for  terms
25    that  commence on the date of their appointment and expire on
26    the second Monday in January, 2001.  Upon expiration  of  the
27    terms  of  the  members  initially appointed by the Governor,
28    their respective successors shall be appointed for terms of 6
29    years from the second Monday in January of each odd  numbered
30    year  and until their respective successors are appointed and
31    qualified.
32        Vacancies shall be filled for the unexpired term  in  the
33    same  manner  as  original  appointments.   If  a  vacancy in
34    membership occurs at  a  time  when  the  Senate  is  not  in

 1    session, the Governor shall make temporary appointments until
 2    the next meeting of the Senate, when he shall appoint persons
 3    to   fill   such  memberships  for  the  remainder  of  their
 4    respective terms.  If the  Senate  is  not  in  session  when
 5    appointments  for a full term are made, appointments shall be
 6    made as in the case of vacancies.
 7        No action of the board shall be invalidated by reason  of
 8    any  vacancies  on  the board, or by reason of any failure to
 9    select nonvoting student members.

12        Section  10.  The Southern Illinois University Management
13    Act is amended by changing Sections 2 and 5 as follows:
14        (110 ILCS 520/2) (from Ch. 144, par. 652)
15        Sec. 2. The Board shall consist of 7 members appointed by
16    the Governor, by and with  the  advice  and  consent  of  the
17    Senate,  the  Superintendent  of  Public  Instruction, or his
18    chief  assistant  for  liaison  with  higher  education  when
19    designated to serve in his place, ex-officio, and, until July
20    1, 2001, one voting student member designated by the Governor
21    from one campus of the University and one  nonvoting  student
22    member  from  the campus of the University not represented by
23    the voting student member.  The Governor shall designate  one
24    of  the student members serving on the Board on the effective
25    date of this amendatory Act of  1997 to serve as  the  voting
26    student  member  for  the remainder of that student's term on
27    the Board.  Beginning on July 1, 2001, and thereafter, the  2
28    student  members  of  the Board shall be nonvoting members, 2
29    nonvoting  student  members  each  to  be  selected  by   the
30    respective   campuses  of  Southern  Illinois  University  at
31    Carbondale and Edwardsville.  Until June 30, 1998, the method
32    of selecting these student members  shall  be  determined  by

 1    campus-wide  student  referendum.    For  a nonvoting student
 2    member whose term begins on July 1, 1998, or on July 1  of  a
 3    subsequent  calendar  year,  the  method  of  selection shall
 4    continue  to  be  determined   by   a   campus-wide   student
 5    referendum.  For a voting student member whose term begins on
 6    July  1,  1998,  or  on  July 1 of either of the 2 succeeding
 7    calendar years,  the  Governor  shall  designate  the  voting
 8    student  member  from  a  list of candidates submitted by the
 9    Student  Trustee  Screening  Panel.   The   Student   Trustee
10    Screening  Panel  consisting  of 6 members shall be appointed
11    each January as follows:  3  appointed by  the  President  of
12    the  University and 3 selected by the student government.  On
13    or before March 1 of each year, the Student Trustee Screening
14    Panel shall provide the Governor with a list of 4  candidates
15    for  the  position of the  voting student member. The student
16    members shall serve terms of one year beginning on July 1  of
17    each year, except that the student members initially selected
18    shall  serve  a  term beginning on the date of such selection
19    and expiring on the next succeeding June 30. To  be  eligible
20    for  selection  as  a  student  member,  to  be  eligible for
21    designation by the Governor (as provided in Section 5)  as  a
22    student  member who has the right to vote, and to be eligible
23    to remain as a voting or  nonvoting  student  member  of  the
24    Board,  a  student  member  must be a resident of this State,
25    must  have  and  maintain  a  grade  point  average  that  is
26    equivalent to at least 2.5 on a 4.0 scale, and must be a full
27    time student enrolled  at all times during his or her term of
28    office except for that part of the  term  which  follows  the
29    completion  of  the last full regular semester of an academic
30    year and precedes the first  full  regular  semester  of  the
31    succeeding   academic   year  at  the  university  (sometimes
32    commonly referred to as the summer session or summer school).
33    If a voting or nonvoting student member serving on the  Board
34    fails  to continue to meet or maintain the residency, minimum

 1    grade point average, or enrollment requirement established by
 2    this Section, his or her membership on  the  Board  shall  be
 3    deemed to have terminated by operation of law. No more than 4
 4    of  the members appointed by the Governor shall be affiliated
 5    with the same political party. Upon  the  expiration  of  the
 6    terms  of members appointed by the Governor, their respective
 7    successors shall be appointed for terms of 6 years  from  the
 8    third  Monday  in January of each odd-numbered year and until
 9    their respective successors are appointed for like terms.  If
10    the Senate is not in session appointments shall be made as in
11    the case of vacancies.

15    secret ballot from their own  number  a  chairman  who  shall
16    preside over meetings of the Board and a secretary.
17        Meetings  of  the  Board shall be held at least once each
18    quarter on a campus of Southern Illinois University.  At  all
19    regular  meetings of the Board, a majority of its voting four
20    members shall constitute  a  quorum.  The  nonvoting  student
21    members  shall  have  all  of  the  privileges of membership,
22    including the right to make and second motions and to  attend
23    executive sessions, other than the right to vote, except that
24    until  July  1,  2001  the  student  member designated by the
25    Governor as the voting student member shall have the right to
26    vote on all Board  matters  except  those  involving  faculty
27    tenure,  faculty  promotion or any issue on which the student
28    member has a direct conflict of interest.  A  student  member
29    who is not entitled to vote on a measure at a meeting  of the
30    Board  or  any  of  its  committees shall not be considered a
31    member for the purpose of determining  whether  a  quorum  is
32    present  at  the  time  that measure is voted upon., but they

 8        Section  15.  The Chicago State University Law is amended
 9    by changing Sections 5-15 and 5-25 as follows:

25    considered a member for purposes of determining a  quorum  at
26    any meeting of the Board or any of its committees.  No action
27    of  the Board shall be invalidated by reason of any vacancies
28    on the Board  or  by  reason  of  any  failure  to  select  a
29    nonvoting student member.
30        Special  meetings  of  the  Board  may  be  called by the
31    chairman of the Board or by any 3 members of the Board.
