      New Act
      35 ILCS 200/15-35
          Creates the Higher Education Facilities  Support  Act  of
      1997.   Creates  only a short title.  Amends the Property Tax
      Code  by  making  technical  corrections   in   the   Section
      concerning  the  exemption for schools.  Effective January 1,
      1998.

 1        AN ACT concerning education.
 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:
 4        Section  1.   Short  title.  This Act may be cited as the
 5    Higher Education Facilities Support Act of 1997.
 6        Section 50.  The Property Tax Code is amended by changing
 7    Section 15-35 as follows:
 8        (35 ILCS 200/15-35)
 9        Sec. 15-35.  Schools.  All property donated by the United
10    States for school purposes, and all property of schools,  not
11    sold  or  leased  or otherwise used with a view to profit, is
12    exempt, whether owned by a resident or non-resident  of  this
13    State  or  by  a corporation incorporated in any state of the
14    United States.  Also exempt is:
15        (a)  property of  schools  that  which  is  leased  to  a
16    municipality   to   be  used  for  municipal  purposes  on  a
17    not-for-profit basis; ,
18        (b)  property of schools on which the schools are located
19    and any  other  property  of  schools  used  by  the  schools
20    exclusively  for  school purposes, including, but not limited
21    to, student residence halls, dormitories  and  other  housing
22    facilities for students and their spouses and children, staff
23    housing  facilities,  and school-owned and operated dormitory
24    or residence halls occupied in whole or in part  by  students
25    who  belong  to  fraternities,  sororities,  or  other campus
26    organizations; .
27        (c)  property donated,  granted,  received  or  used  for
28    public  school, college, theological seminary, university, or
29    other  educational  purposes,  whether  held  in   trust   or
30    absolutely; and,

 1        (d)  in counties with more than 200,000 inhabitants which
 2    classify property,  property (including interests in land and
 3    other  facilities)  on or adjacent to (even if separated by a
 4    public street, alley, sidewalk, parkway or other public  way)
 5    the  grounds  of  a  school,  if  that property is used by an
 6    academic,  research  or  professional   society,   institute,
 7    association  or  organization which serves the advancement of
 8    learning in a field or fields of study taught by  the  school
 9    and which property is not used with a view to profit.

11        Section  99.   Effective  date.  This Act takes effect on
12    January 1, 1998.
