      20 ILCS 1305/10-30 new
          Amends the Department of Human Services Act to allow  the
      Department  to  enter  into  a contract with a not-for-profit
      organization to establish a revolving loan program to  assist
      not-for-profit    organizations    that   work   in   service
      partnerships with the State to  maintain  and  improve  their
      facilities.  Effective July 1, 1997.

 1        AN  ACT  to amend the Department of Human Services Act by
 2    adding Section 10-30.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.   The  Department  of  Human  Services Act is
 6    amended by adding Section 10-30 as follows:
 7        (20 ILCS 1305/10-30 new)
 8        Sec.  10-30.  Revolving  loan  program  to  maintain  and
 9    improve not-for-profit organizations' facilities.
10        (a)  The Department may enter  into  a  contract  with  a
11    statewide   not-for-profit  community  development  financial
12    institution to establish a revolving  loan  program  for  the
13    purpose  of  assisting  Illinois not-for-profit organizations
14    that work in service partnerships with the State to  maintain
15    and improve their facilities.
16        (b)  The contract shall require all of the following:
17             (1)  All  principal  to  be  used  by  the statewide
18        not-for-profit    community     development     financial
19        institution  to  make  loans  to qualifying borrowers, to
20        serve as collateral for borrowers, and to leverage  other
21        private funds.
22             (2)  Participation by a Department representative in
23        screening applicants.
24             (3)  Interest  to  be  used to defray administrative
25        costs for  borrowers  and  the  statewide  not-for-profit
26        community  development  financial  institution, including
27        but not limited to legal fees,  underwriting  costs,  and
28        the cost of required environmental studies.
29             (4)  Repaid  principal  to  be  used  for  the  same
30        purpose as original principal.
31        (c)  This  revolving  loan  program shall be used for the

 1    following purposes:
 2             (1)  To  assist  not-for-profit   organizations   in
 3        meeting regulatory standards.
 4             (2)  To   enable   not-for-profit  organizations  to
 5        comply with the Americans with Disabilities Act.
 6             (3)  To  enable  not-for-profit   organizations   to
 7        remove lead and asbestos from their buildings.
 8             (4)  To  encourage  not-for-profit  organizations to
 9        voluntarily make building improvements that  increase  or
10        improve their ability to serve clients.
11             (5)  To  support  facilities that are appropriate to
12        meeting the goals of the  Department,  including  program
13        mergers, program consolidations, more strategic placement
14        of programs, and more efficient use of space.
15        Section  99.  Effective date.  This Act takes effect July
16    1, 1997.
