Amends the provisions of the School Code relating to
alternative schools. Provides that a teacher who holds an
elementary or high school certificate may teach any class in
the alternative school program. Eliminates a provision under
which a school district in which an alternative program is
located and from which a student is administratively
transferred has its average daily attendance funding with
respect to that student transferred to the alternative school
program. Provides instead that the alternative school
program is to receive general State aid under the formula
established for alternative schools. Provides that the
curriculum of an alternative school program may include
work-based learning and community service work for which
academic credit is earned and includes time spent by a
student in such activities in the number of clock hours of
daily school work required to constitute a day of attendance
for State aid purposes. Provides that the school districts
for which an alternative school program is operated may agree
to provide additional funding to support the program, and
authorizes the program to accept and expend gifts, legacies,
and federal and other grants received for purposes directly
relating to the conduct and operation of the program.

1 AN ACT to amend the School Code by changing Sections
2 13A-5, 13A-6, and 13A-8.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The School Code is amended by changing
6 Sections 13A-5, 13A-6, and 13A-8 as follows:

8 Sec. 13A-5. Alternative school program curriculum.
9 (a) The regional superintendent shall implement, or
10 contract with one or more school districts to implement, a
11 multi-disciplinary curriculum, which may include work-based
12 learning and community service work for which academic credit
13 is earned, for the alternative school program designed to
14 address the individualized needs of the students of that
15 program, with special emphasis toward making the educational
16 experience of each student meaningful and worthwhile. In the
17 design and implementation of that curriculum, the regional
18 superintendent or school district shall give due
19 consideration to the rules and regulations adopted by the
20 State Board of Education for alternative schools and optional
21 education programs.
22 (b) An administratively transferred student who
23 successfully completes the requirements for his or her high
24 school graduation shall receive a diploma identifying the
25 student as graduating from the transferring high school. In
26 the event the student is administratively transferred before
27 enrolling in a high school, then that student shall receive a
28 diploma from the high school the student would have attended
29 if the student had not attended an alternative school
30 program.

2 Sec. 13A-6. Staffing.
3 (a) The regional superintendent shall administer, or
4 contract with one or more school districts to administer,
5 alternative school programs located within the educational
6 service region.
7 (b) The regional superintendent is responsible for the
8 administrative and fiscal structure for the program.
9 (c) A teacher who holds either an elementary certificate
10 or a high school certificate may teach any class in an
11 alternative school program.

14 Sec. 13A-8. Funding.
15 (a) The State of Illinois shall provide new and
16 additional funding for the alternative school programs within
17 each educational service region and within the Chicago public
18 school system by line item appropriation made to the State
19 Board of Education for that purpose. This money, when
20 appropriated, shall be provided to the regional
21 superintendent and to the Chicago Board of Education, who
22 shall establish a budget, including salaries, for all
23 alternative schools in that region.
24 (b) An alternative school program shall be entitled to
25 receive general State aid as calculated in Part B of Section
26 18-8 upon filing a claim as provided therein. Any time that
27 a student who is enrolled in an alternative school program
28 spends in work-based learning, community service, or a
29 similar alternative educational setting shall be included in
30 determining the student's minimum number of clock hours of
31 daily school work that constitute a day of attendance for
32 purposes of calculating general State aid. The school
33 district in which the program is located and from which a

1 student is administratively transferred shall, as a result of
2 an administrative transfer, have its average daily attendance
3 funding with respect to that student transferred to the
4 alternative school program.
5 (c) An alternative school program may receive additional
6 funding from its school districts in such amount as may be
7 agreed upon by the parties and necessary to support the
8 program. In addition, an alternative school program is
9 authorized to accept and expend gifts, legacies, and grants,
10 including but not limited to federal grants, from any source
11 for purposes directly related to the conduct and operation of
12 the program.
