      625 ILCS 5/3-639
          Amends the Illinois Vehicle Code and  the  State  Finance
      Act.    Authorizes   special  license  plates  designated  as
      Education license plates.  Provides for  increased  fees  for
      these  plates  to be distributed, subject to appropriation by
      the General  Assembly,  to  the  State  Board  of  Education.
      Provides  that the State Board of Education shall make grants
      of this money to school districts.

 1        AN ACT concerning license plates, amending named Acts.
 2        Be it enacted by the People of  the  State  of  Illinois,
 3    represented in the General Assembly:
 4        Section  5.  The  State  Finance Act is amended by adding
 5    Section 5.449 as follows:

 7        Sec. 5.449.  The Education License Plate Fund.
 8        Section 10.  The Illinois  Vehicle  Code  is  amended  by
 9    adding Section 3-639 as follows:

11        Sec. 3-639.  Education plates.
12        (a)  The  Secretary,  upon receipt of all applicable fees
13    and  applications  made  in  the  form  prescribed   by   the
14    Secretary,  may  issue special registration plates designated
15    as Education license plates.  The special plates issued under
16    this Section shall be affixed only to passenger  vehicles  of
17    the  first  division or motor vehicles of the second division
18    weighing not more than 8,000 pounds.
19        Plates issued under this Section shall  expire  according
20    to the multi-year procedure established by Section 3-414.1 of
21    this Code.
22        (b)  The  design and color of the special plates shall be
23    wholly within the discretion of the  Secretary.   Appropriate
24    documentation,   as   determined   by  the  Secretary,  shall
25    accompany each application.
26        (c)  An applicant for the special plate shall be  charged
27    a   $40   fee  for  original  issuance  in  addition  to  the
28    appropriate registration fee.  Of  this  fee,  $25  shall  be
29    deposited into the Education License Plate Fund and $15 shall

 1    be  deposited  into  the  Secretary  of State Special License
 2    Plate Fund, to be used by the Secretary to  help  defray  the
 3    administrative processing costs.
 4        For  each  registration  renewal  period,  a  $27 fee, in
 5    addition  to  the  appropriate  registration  fee,  shall  be
 6    charged.  Of this  fee,  $25  shall  be  deposited  into  the
 7    Education  License  Plate Fund and $2 shall be deposited into
 8    the Secretary of State Special License Plate Fund.
 9        (d)  The Education License Plate Fund  is  created  as  a
10    special  fund  in  the State treasury.  All money in the Fund
11    shall be distributed, subject to appropriation by the General
12    Assembly, to the State Board  of  Education.   By  the  first
13    business  day  in  December  of each year, the State Board of
14    Education shall make grants of this money to school districts
15    in the same proportion that the number of pupils  in  average
16    daily  attendance, for the school year ending in the calendar
17    year when the grants will be made, in  each  school  district
18    bears  to  the  total  number  of  pupils  in  average  daily
19    attendance,  for  the school year ending in the calendar year
20    when the grants will be made, in all school districts.
21        As used in this subsection, average daily attendance  has
22    the  meaning  ascribed  to  it  in Section 18-8 of the School
23    Code.
