          Amends the Fireworks  Use  Act.   Includes  sparklers  as
      "fireworks" for purposes of the Act.  Effective immediately.

 1        AN ACT to amend the Fireworks Use Act by changing Section
 2    1.
 3        Be  it  enacted  by  the People of the State of Illinois,
 4    represented in the General Assembly:
 5        Section 5.  The Fireworks Use Act is amended by  changing
 6    Section 1 as follows:
 7        (425 ILCS 35/1) (from Ch. 127 1/2, par. 127)
 8        Sec.  1.   The  term fireworks shall mean and include any
 9    explosive composition, or any  substance  or  combination  of
10    substances,  or article prepared for the purpose of producing
11    a visible or  audible  effect  of  a  temporary  exhibitional
12    nature  by explosion, combustion, deflagration or detonation,
13    and shall include blank cartridges,  toy  cannons,  in  which
14    explosives  are used, the type of balloons which require fire
15    underneath  to  propel  the  same,  firecrackers,  torpedoes,
16    skyrockets,  Roman  candles,  sparklers,  bombs,   or   other
17    fireworks  of  like construction and any fireworks containing
18    any explosive  compound,  or  any  tablets  or  other  device
19    containing any explosive substance, or containing combustible
20    substances  producing visual effects: provided, however, that
21    the term "fireworks" shall not include  snake  or  glow  worm
22    pellets;  smoke  devices;  trick  noisemakers known as "party
23    poppers",  "booby  traps",   "snappers",   "trick   matches",
24    "cigarette  loads"  and "auto burglar alarms"; sparklers; toy
25    pistols, toy canes, toy guns, or other devices in which paper
26    or plastic caps containing twenty-five hundredths  grains  or
27    less  of  explosive  compound are used, providing they are so
28    constructed that the hand cannot come in contact with the cap
29    when in place for the explosion;  and  toy  pistol  paper  or
30    plastic caps which contain less than twenty hundredths grains
31    of  explosive  mixture;  the  sale  and use of which shall be

 1    permitted at all times.

 3        Section 99.  Effective date.  This Act takes effect  upon
 4    becoming law.
