Department of Insurance to publish a pamphlet providing a
general explanation of the procedures for resolving
automobile insurance claims. Requires insurance companies and
adjusters to include the pamphlet in any correspondence with
an insured regarding a claim.

1 AN ACT to amend the Illinois Insurance Code by adding
2 Section 143.32.
3 Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
5 Section 5. The Illinois Insurance Code is amended by
6 adding Section 143.32 as follows:
7 (215 ILCS 5/143.32 new)
8 Sec. 143.32. Claim procedures; notice.
9 (a) The Department shall prepare and publish a pamphlet
10 that provides a general explanation of the procedures
11 involved in resolving claims under a policy of automobile
12 insurance, as defined in Section 143.13. The pamphlet shall
13 provide information concerning the obtaining of estimates,
14 choice of repair facilities, source of repair parts,
15 collision damage waivers, liability waivers, and the basis
16 for determining to whom a claims payment check is payable.
17 (b) The pamphlet shall be printed in the English
18 language and in other languages the Department determines to
19 be necessary to make the information available to insureds in
20 this State.
21 (c) An insurance company and a public insurance adjuster
22 shall obtain the pamphlets from the Department and include
23 the pamphlet in any correspondence with an insured regarding
24 a claim under a policy of automobile insurance.
