 1                     AMENDMENT TO HOUSE BILL 651
 2        AMENDMENT NO.     .  Amend House Bill 651, AS AMENDED, by
 3    replacing subsection (b) of Sec. 12-3.2 of Section 5 with the
 4    following:
 5        "(b)  Sentence.   Domestic   battery   is   a   Class   A
 6    Misdemeanor  for  which  the  offender  shall  be mandatorily
 7    sentenced  to  a  minimum  of   48   consecutive   hours   of
 8    imprisonment.   The  imprisonment  shall  not  be  subject to
 9    suspension, nor shall the person be eligible for probation in
10    order to  reduce  the  sentence.   A  second  and  subsequent
11    violation  is  a  Class 4 felony for which the offender shall
12    be mandatorily sentenced to a minimum  of  96  nonconsecutive
13    hours of imprisonment.  The imprisonment shall not be subject
14    to suspension, nor shall the person be eligible for probation
15    in  order  to  reduce the sentence.  In addition to any other
16    sentencing  alternatives,  for  any  second   conviction   of
17    violating   this   Section  within  5  years  of  a  previous
18    conviction for violating this Section, the offender shall  be
19    mandatorily sentenced to a minimum of 48 consecutive hours of
20    imprisonment.   The  imprisonment  shall  not  be  subject to
21    suspension, nor shall the person be eligible for probation in
22    order to reduce the sentence.".
