          Amends the Environmental Protection Act  to  require  the
      Pollution  Control  Board to adopt rules by September 1, 1998
      prohibiting the open burning of landscape waste in  areas  of
      the State classified as moderate, serious, severe, or extreme
      non-attainment   areas  for  ozone  or  areas  designated  as
      affected counties under the Vehicle Emissions Inspection  Law
      of 1995. Preempts certain home rule powers.

 1        AN  ACT to amend the Illinois Forestry Development Act by
 2    changing Section 6a.
 3        Be it enacted by the People of  the  State  of  Illinois,
 4    represented in the General Assembly:
 5        Section  5.  The  Illinois  Forestry  Development  Act is
 6    amended by changing Section 6a as follows:
 7        (525 ILCS 15/6a) (from Ch. 96 1/2, par. 9106a)
 8        Sec. 6a. Illinois Forestry Development Council.
 9        (a)  The Illinois Forestry Development Council is  hereby
10    recreated.
11        (b)  The Council shall consist of 24 members appointed as
12    follows:
13             (1)  four  members  of  the  General  Assembly,  one
14        appointed  by  the President of the Senate, one appointed
15        by the Senate  Minority  Leader,  one  appointed  by  the
16        Speaker   of   the  House  of  Representatives,  and  one
17        appointed by the House Minority Leader;
18             (2)  one  member  appointed  by  the   Governor   to
19        represent the Governor;
20             (3)  the  Directors  of  the  Departments of Natural
21        Resources,  Agriculture,  and  Commerce   and   Community
22        Affairs,  the  Executive  Director  of  the Illinois Farm
23        Development Authority, and the Director of the Office  of
24        Rural Affairs, or their designees;
25             (4)  the chairman of the Department of Forestry or a
26        forestry   academician,   appointed   by   the   Dean  of
27        Agriculture   at   Southern   Illinois   University    at
28        Carbondale;
29             (5)  the head of the Department of Natural Resources
30        and  Environmental  Sciences  or  a forestry academician,
31        appointed by the Dean of Agriculture at the University of

 1        Illinois;
 2             (6)  two members, appointed  by  the  Governor,  who
 3        shall be private timber growers;
 4             (7)  one  member,  appointed by the president of the
 5        Illinois Wood Products Association, who shall be involved
 6        in primary forestry industry;
 7             (8)  one member, appointed by the president  of  the
 8        Illinois Wood Products Association, who shall be involved
 9        in secondary forestry industry;
10             (9)  one   member   who   is  actively  involved  in
11        environmental issues, appointed by the Governor;
12             (10)  the president of the Association  of  Illinois
13        Soil and Water Conservation Districts;
14             (11)  two   persons  who  are  actively  engaged  in
15        farming, appointed by the Governor;
16             (12)  one member, appointed by the  Governor,  whose
17        primary area of expertise is urban forestry;
18             (13)  one  member  appointed by the President of the
19        Illinois Arborists Association;
20             (14)  The Supervisor of the Shawnee National  Forest
21        and  the  United States Department of Agriculture Natural
22        Resource Conservation Service's State Conservationist, ex
23        officio, or their designees.
24        (c)  Members  of  the   Council   shall   serve   without
25    compensation  but  shall  be  reimbursed  for actual expenses
26    incurred in the performance of their  duties  which  are  not
27    otherwise reimbursed.
28        (d)  The  Council  shall  select  from  its  membership a
29    chairperson  and  such  other  officers   as   it   considers
30    necessary.
31        (e)  Other individuals, agencies and organizations may be
32    invited to participate as deemed advisable by the Council.
33        (f)  The  Council  shall  study and evaluate the forestry
34    resources and forestry industry  of  Illinois.   The  Council

 1    shall:
 2             (1)  determine  the  magnitude, nature and extent of
 3        the State's forestry resources;
 4             (2)  determine  current  uses  and  project   future
 5        demand  for  forest  products,  services  and benefits in
 6        Illinois;
 7             (3)  determine   and    evaluate    the    ownership
 8        characteristics  of  the State's forests, the motives for
 9        forest ownership and the success of incentives  necessary
10        to stimulate development of forest resources;
11             (4)  determine    the   economic   development   and
12        management   opportunities   that   could   result   from
13        improvements  in  local  and  regional   forest   product
14        marketing and from the establishment of new or additional
15        wood-related businesses in Illinois;
16             (5)  confer   with   and  offer  assistance  to  the
17        Illinois  Farm  Development  Authority  relating  to  its
18        implementation of  forest  industry  assistance  programs
19        authorized by the Illinois Farm Development Act;
20             (6)  determine   the  opportunities  for  increasing
21        employment and economic  growth  through  development  of
22        forest resources;
23             (7)  determine  the  effect  of current governmental
24        policies and regulations on the management  of  woodlands
25        and the location of wood products markets;
26             (8)  determine  the  staffing  and funding needs for
27        forestry and other conservation programs to  support  and
28        enhance forest resources development;
29             (9)  determine   the  needs  of  forestry  education
30        programs in this State;
31             (10)  confer  with  and  offer  assistance  to   the
32        Department   of   Natural   Resources   relating  to  the
33        implementation  of  urban  forestry   assistance   grants
34        pursuant  to  the Urban and Community Forestry Assistance

 1        Act; and
 2             (11)  determine soil and water conservation benefits
 3        and wildlife habitat enhancement opportunities  that  can
 4        be promoted through approved forestry management plans.
 5        (g)  The   Council   shall   report   its   findings  and
 6    recommendations  for  future  State  action  to  the  General
 7    Assembly no later than July 1 of each year, 1988.
 8        (h)  This Section 6a is repealed December 31, 2008 1998.

11        Section 99.  Effective date.  This Act takes effect  upon
12    becoming law.
