Illinois Compiled Statutes (ILCS)

Recent laws may not yet be included in the ILCS database, but they are found on this site as Public Acts soon after they become law. For information concerning the relationship between statutes and Public Acts, refer to the Guide.

Because the statute database is maintained primarily for legislative drafting purposes, statutory changes are sometimes included in the statute database before they take effect. If the source note at the end of a Section of the statutes includes a Public Act that has not yet taken effect, the version of the law that is currently in effect may have already been removed from the database and you should refer to that Public Act to see the changes made to the current law.

    (750 ILCS 46/201)
    Sec. 201. Establishment of parent-child relationship.
    (a) The parent-child relationship is established between a person and a child by:
        (1) the woman or person having given birth to the
    
child, except as otherwise provided in the Gestational Surrogacy Act;
        (2) a presumption of the person's parentage of the
    
child under Section 204 of this Act unless the presumption is overcome in a judicial proceeding or a valid denial of parentage is made under Section 303 of this Act;
        (3) an effective voluntary acknowledgment of
    
parentage by the person under Article 3 of this Act, unless the acknowledgment has been rescinded or successfully challenged;
        (4) an adjudication of the person's parentage;
        (5) the person's adoption of the child;
        (6) the person's consent to assisted reproduction
    
under Article 7 of this Act; or
        (7) the person's parentage of the child is
    
established under the provisions of the Gestational Surrogacy Act.
