Illinois Compiled Statutes (ILCS)
Updating the database of the Illinois Compiled Statutes (ILCS) is an ongoing process. Recent laws may not yet be included in the ILCS database, but they are found on this site as Public Acts soon after they become law. For information concerning the relationship between statutes and Public Acts, refer to the Guide.
Because the statute database is maintained primarily for legislative drafting purposes, statutory changes are sometimes included in the statute database before they take effect. If the source note at the end of a Section of the statutes includes a Public Act that has not yet taken effect, the version of the law that is currently in effect may have already been removed from the database and you should refer to that Public Act to see the changes made to the current law.
(730 ILCS 5/5-6-3.7) (This Section may contain text from a Public Act with a delayed effective date) Sec. 5-6-3.7. Unlawful possession of weapons offense diversion programs; Firearm Owner's Identification Card eligibility. (a) A State's Attorney, at his or her discretion, may request that a defendant charged with an unlawful possession of weapons offense under Section 24-1 of the Criminal Code of 2012 or aggravated unlawful possession of a weapon offense under Section 24-1.6 of the Criminal Code of 2012, if punishable as a Class 4 felony or lower, be sentenced to an appropriate diversion program. (b) Upon the successful completion of the diversion program, a defendant may submit an application for a Firearm Owner's Identification Card upon receiving a court order demonstrating completion of the program. The Illinois State Police shall issue a Firearm Owner's Identification Card to such person upon receiving a court order demonstrating completion of the program if the person is otherwise eligible to receive a Firearm Owner's Identification Card. Nothing in this Section shall prohibit the Illinois State Police from denying an application for or revoking a Firearm Owner's Identification Card as provided by law.(Source: P.A. 104-398, eff. 1-1-26.) |
