Illinois Compiled Statutes (ILCS)
Updating the database of the Illinois Compiled Statutes (ILCS) is an ongoing process. Recent laws may not yet be included in the ILCS database, but they are found on this site as Public Acts soon after they become law. For information concerning the relationship between statutes and Public Acts, refer to the Guide.
Because the statute database is maintained primarily for legislative drafting purposes, statutory changes are sometimes included in the statute database before they take effect. If the source note at the end of a Section of the statutes includes a Public Act that has not yet taken effect, the version of the law that is currently in effect may have already been removed from the database and you should refer to that Public Act to see the changes made to the current law.
(35 ILCS 10/5-20) Sec. 5-20. Application for a project to create and retain new jobs. (a) Any Taxpayer proposing a project located or planned to be located in Illinois may request consideration for designation of its project, by formal written letter of request or by formal application to the Department, in which the Applicant states its intent to make at least a specified level of investment and intends to hire or retain a specified number of full-time employees at a designated location in Illinois. As circumstances require, the Department may require a formal application from an Applicant and a formal letter of request for assistance. (b) In order to qualify for Credits under this Act, an Applicant's project must: (1) if the Applicant has more than 100 employees, | ||

(1.5) if the Applicant has more than 100 employees, | ||

(1.6) if the Applicant is a startup taxpayer, the | ||

(1.7) if the agreement is entered into on or after | ||
| ||
(A) makes an investment of at least $50,000,000 | ||

(B) is placed in service after approval of the | ||
| ||
(C) creates jobs for at least 100 new full-time | ||
| ||
(1.8) if the agreement is entered into on or after | ||
| ||
(A) makes an investment of at least $100,000,000 | ||
| ||
(B) is placed in service as described within the | ||
| ||
(C) retains at least 500 full-time employees. (2) (blank); (3) (blank); and (4) include an annual sexual harassment policy report | ||
