Updating the database of the Illinois Compiled Statutes (ILCS) is an ongoing process. Recent laws may not yet be included in the ILCS database, but they are found on this site as Public Acts soon after they become law. For information concerning the relationship between statutes and Public Acts, refer to the Guide.

Because the statute database is maintained primarily for legislative drafting purposes, statutory changes are sometimes included in the statute database before they take effect. If the source note at the end of a Section of the statutes includes a Public Act that has not yet taken effect, the version of the law that is currently in effect may have already been removed from the database and you should refer to that Public Act to see the changes made to the current law.

320 ILCS 25/3.14

Sec. 3.14.

"Person with a disability" means a person unable to engage in any substantial
gainful activity by reason of a medically determinable physical or mental
impairment which can be expected to result in death or has lasted or can be
expected to last for a continuous period of not less than 12 months.
Persons with disabilities filing claims under this Act shall submit proof of
the disability in such form and manner as the Department shall by rule and
regulation prescribe. Proof that a claimant is eligible to receive
disability benefits under the Federal Social Security Act shall constitute
proof of the disability for purposes of this Act.  Issuance of an Illinois
 Person with a Disability Identification Card stating that the claimant is under a
Class 2 disability, as defined in Section 4A of the Illinois Identification
Card Act, shall constitute proof that the person named thereon is a
person with a disability for purposes of this Act.  A person with a disability not covered
under the Federal Social Security Act
and not presenting a Disabled Person Identification Card stating that
the claimant is under a Class 2 disability
shall be examined by a physician
designated by the Department, and his status as a person with a disability 
determined using the same standards as used by the Social Security
Administration. The costs of any required examination shall be borne by the
claimant.
