| AN ACT concerning State government.
| 2 |
| Be it enacted by the People of the State of Illinois,
| 3 |
| represented in the General Assembly:
| 4 |
| Section 5. The Department of State Police Law of the
Civil | 5 |
| Administrative Code of Illinois is amended by changing Sections | 6 |
| 2605-5 and 2605-375 as follows:
| 7 |
| (20 ILCS 2605/2605-5)
| 8 |
| Sec. 2605-5. Definitions. In this Law:
| 9 |
| "Department" means the Department of State Police.
| 10 |
| "Director" means the Director of State Police. | 11 |
| "Missing endangered senior" means an individual 65 years of | 12 |
| age or older who is reported missing to a law enforcement | 13 |
| agency and is, or is believed to be: | 14 |
| (1) a temporary or permanent resident of Illinois; | 15 |
| (2) at a location that cannot be determined by an | 16 |
| individual familiar with the missing individual; and | 17 |
| (3) incapable of returning to the individual's | 18 |
| residence without assistance.

| Sec. 2605-375. Missing persons; Law Enforcement Agencies | 22 |
| Data System
(LEADS).
| 23 |
| (a) To establish and maintain a statewide Law Enforcement
| 24 |
| Agencies Data System (LEADS) for the purpose of providing | 25 |
| electronic access
by authorized entities to criminal justice | 26 |
| data repositories and effecting an
immediate law enforcement | 27 |
| response to reports of missing persons, including
lost, missing | 28 |
| or runaway minors and missing endangered seniors . The | 29 |
| Department shall implement an automatic
data exchange system to | 30 |
| compile, to maintain, and to make available to
other law
| 31 |
| enforcement agencies for immediate dissemination data that can

| assist
appropriate agencies in recovering missing persons and | 2 |
| provide access by
authorized entities to various data | 3 |
| repositories available through LEADS for
criminal justice and | 4 |
| related purposes. To assist the Department in
this effort, | 5 |
| funds may be appropriated from the LEADS Maintenance Fund.
| 6 |
| (b) In exercising its duties under this Section, the
| 7 |
| Department shall do the following:
| 8 |
| (1) Provide a uniform reporting format for the entry of | 9 |
| pertinent
information regarding the report of a missing | 10 |
| person into LEADS. The report must include all of the | 11 |
| following:
| 12 |
| (A) Relevant information obtained from the | 13 |
| notification concerning the missing person, including | 14 |
| all of the following: | 15 |
| (i) a physical description of the missing | 16 |
| person; | 17 |
| (ii) the date, time, and place that the missing | 18 |
| person was last seen; and | 19 |
| (iii) the missing person's address. | 20 |
| (B) Information gathered by a preliminary | 21 |
| investigation, if one was made. | 22 |
| (C) A statement by the law enforcement officer in | 23 |
| charge stating the officer's assessment of the case | 24 |
| based on the evidence and information received. | 25 |
| The Department of State Police shall prepare the report | 26 |
| required by this paragraph (1) as soon as practical, but | 27 |
| not later than 5 hours after the Department receives | 28 |
| notification of a missing person.
| 29 |
| (2) Develop and implement a policy whereby a statewide | 30 |
| or regional alert
would be used in situations relating to | 31 |
| the disappearances of individuals,
based on criteria and in | 32 |
| a format established by the Department. Such a
format shall | 33 |
| include, but not be limited to, the age of the missing | 34 |
| person
and the suspected circumstance of the | 35 |
| disappearance.
| 36 |
| (3) Notify all law enforcement agencies that reports of |

| missing persons
shall be entered as soon as the minimum | 2 |
| level of data specified by the
Department is available to | 3 |
| the reporting agency and that no waiting period
for the | 4 |
| entry of the data exists.
| 5 |
| (4) Compile and retain information regarding lost, | 6 |
| abducted, missing,
or
runaway minors in a separate data | 7 |
| file, in a manner that allows that
information to be used | 8 |
| by law enforcement and other agencies deemed
appropriate by | 9 |
| the Director, for investigative purposes. The
information
| 10 |
| shall include the disposition of all reported lost, | 11 |
| abducted, missing, or
runaway minor cases.
| 12 |
| (5) Compile and maintain an historic data repository | 13 |
| relating to lost,
abducted, missing, or runaway minors and | 14 |
| other missing persons , including, but not limited to, | 15 |
| missing endangered seniors in order to
develop and improve | 16 |
| techniques utilized by law enforcement agencies when
| 17 |
| responding to reports of missing persons.
| 18 |
| (6) Create a quality control program regarding | 19 |
| confirmation of missing
person data, timeliness of entries | 20 |
| of missing person reports into LEADS,
and
performance | 21 |
| audits of all entering agencies. | 22 |
| (7) Upon completion of the report required by paragraph | 23 |
| (1), the Department of State Police shall immediately | 24 |
| forward the contents of the report to all of the following: | 25 |
| (A) all law enforcement agencies that have | 26 |
| jurisdiction in the location where the missing person | 27 |
| lives and all law enforcement agencies that have | 28 |
| jurisdiction in the location where the missing person | 29 |
| was last seen; | 30 |
| (B) all law enforcement agencies to which the | 31 |
| person who made the notification concerning the | 32 |
| missing person requests the report be sent, if the | 33 |
| Department determines that the request is reasonable | 34 |
| in light of the information received; | 35 |
| (C) all law enforcement agencies that request a | 36 |
| copy of the report; and |

| (D) the National Crime Information Center's | 2 |
| Missing Person File, if appropriate.
| 3 |
| (8) The Department of State Police shall begin an | 4 |
| investigation concerning the missing person not later than | 5 |
| 24 hours after receiving notification of a missing person. | 6 |
| (c) The Illinois Law Enforcement Training Standards Board | 7 |
| shall conduct a training program for law enforcement personnel | 8 |
| of local governmental agencies in the statewide coordinated | 9 |
| missing endangered senior alert system established under this | 10 |
| Section.

| Section 10. The Illinois Police Training Act is amended by | 15 |
| changing Section 10.10 as follows:

| 17 |
| Sec. 10.10. Training in child abduction and missing | 18 |
| endangered senior alert system. The Board shall
conduct a
| 19 |
| training program for law enforcement personnel of local | 20 |
| governmental agencies
in the
statewide coordinated child | 21 |
| abduction alert system developed under Section
2605-480 of
the | 22 |
| Department of State Police Law of the Civil Administrative Code | 23 |
| of
Illinois and the statewide coordinated missing endangered | 24 |
| senior alert system developed under Section 2605-375 of the | 25 |
| Department of State Police Law of the
Civil Administrative Code | 26 |
| of Illinois .

| Section 99. Effective date. This Act takes effect January | 29 |
