SYNOPSIS AS INTRODUCED:
 
70 ILCS 2605/4.2   from Ch. 42, par. 323.2

    Amends the Metropolitan Water Reclamation District Act. Deletes a provision that establishes a salary for each member of the civil service board of the Metropolitan Water Reclamation District. Provides that compensation for each member of the board shall be established by the District's Board of Commissioners as part of the annual budget process.

1     AN ACT concerning the Metropolitan Water Reclamation
2 District.
 
3     Be it enacted by the People of the State of Illinois,
4 represented in the General Assembly:
 
5     Section 5. The Metropolitan Water Reclamation District Act
6 is amended by changing Section 4.2 as follows:
 
7     (70 ILCS 2605/4.2)  (from Ch. 42, par. 323.2)
8     Sec. 4.2. There is hereby created and established a civil
9 service board to consist of 3 persons to be selected in the
10 manner following:
11     The governing authority or body of the sanitary district,
12 hereinafter called the trustees, shall on or before January 31,
13 1952 appoint a civil service board of 3 members, all of whom
14 shall be persons who are not trustees and not more than 2 of
15 whom shall be affiliated with the same political party. Each
16 member shall have been a qualified elector of the sanitary
17 district for at least 5 years immediately prior to his or her
18 appointment and shall believe firmly in the merit system of
19 government. No person shall be appointed to the civil service
20 board who has held an elective public office or a position in a
21 political party within the 2 years immediately prior to his or
22 her appointment. No member of the board shall be a member of a
23 committee in any partisan political club or organization, or
24 shall hold or be a candidate for any elective public office.
25     Of the members so appointed, one shall be appointed for a
26 term of 2 years, one for a term of 4 years and one for a term of
27 6 years beginning February 1, 1952. All subsequent appointments
28 shall be for 6 year terms beginning February 1 of the year in
29 which the antecedent term expires. In the event a vacancy
30 occurs from any cause in the office of any member, the
31 unexpired portion of the term shall be filled by appointment
32 within 60 days by the trustees. The board shall elect from its

1 members a chairman, vice-chairman and secretary. Each shall
2 serve for a term of 2 years or until a successor is elected.
3 Compensation for each member of the board shall be established
4 by the District's Board of Commissioners as part of the annual
5 budget process. Each member of the board shall receive a salary
6 of $15,000 per annum, except the Chairman, who shall receive a
7 salary of $17,500 per annum. Two members of the civil service
8 board shall constitute a quorum, but in no instance shall the
9 board have authority or exercise responsibility if 60 days
10 after a vacancy exists on the board it has not been filled by
11 appointment.
12     No member of the civil service board shall be removed
13 except for palpable incompetence or malfeasance in office upon
14 written charges filed by or at the direction of the trustees
15 and heard before the trustees sitting as the board of hearings
16 herein provided for.
17     The board of hearings shall hear and determine the charges
18 and its findings shall be final. If the charges are sustained,
19 the member of the civil service board so charged shall be
20 forthwith removed from office by the board of hearings and the
21 trustees shall thereupon proceed within 30 days to fill the
22 vacancy created by that removal. In all proceedings provided
23 for in this Section, the board of hearings and each member
24 thereof shall have power to administer oaths and to compel by
25 subpoena the attendance and testimony of witnesses and the
26 production of books and papers.
