 1        AN ACT in relation to agriculture.

 2        Be  it  enacted  by  the People of the State of Illinois,
 3    represented in the General Assembly:

 4        Section 5.  The Livestock Management  Facilities  Act  is
 5    amended by changing Section 10.30 as follows:

 6        (510 ILCS 77/10.30)
 7        Sec.  10.30.  Livestock  management  facility. "Livestock
 8    management facility"  means  any  animal  feeding  operation,
 9    livestock   shelter,  or  on-farm  milking  and  accompanying
10    milk-handling  area.  Two  or   more   livestock   management
11    facilities  under  common ownership, where the facilities are
12    not separated by a minimum distance of  1/4  mile,  and  that
13    share  a  common  livestock  waste handling facility shall be
14    considered  a  single  livestock  management   facility.    A
15    Livestock   management  facilities  facility  at  educational
16    institutions, livestock pasture operations, where animals are
17    housed on a temporary basis such as county and  state  fairs,
18    livestock  shows, race tracks, and horse breeding and foaling
19    farms, and market holding facilities are not subject to  this
20    Act.
