SYNOPSIS AS INTRODUCED:
 
New Act
30 ILCS 105/5.970 new

    Creates the Fund the Police Act. Creates the Fund the Police Grant Fund as a special fund in the State treasury. Provides that from appropriations to the Illinois Law Enforcement Training Standards Board from the Fund, the Board must make grants to units of local government and Illinois public universities for the purpose of: (1) hiring law enforcement officers; (2) providing mental health care for law enforcement officers; (3) providing for hiring, retention incentives, and overtime payments for law enforcement officers; (4) purchasing public safety equipment designed to prevent gang violence, motor vehicle theft, vehicular hijacking, or the sale of contraband; and (5) training for law enforcement officers in preventing gang violence, motor vehicle theft, vehicular hijacking, or the sale of contraband. Provides that moneys in the Fund the Police Grant Fund may not be appropriated, assigned, or transferred to another State fund. Provides that, as soon as practical after the effective date of the Act, the State Comptroller shall direct and the State Treasurer shall transfer the sum of $100,000,000 from the General Revenue Fund to the Fund the Police Grant Fund. Amends the State Finance Act to make conforming changes.

1    AN ACT concerning finance.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 1. Short title. This Act may be cited as the Fund
5the Police Act.
 
6    Section 5. Definition. In this Act, "Board" means the
7Illinois Law Enforcement Training Standards Board created by
8the Illinois Police Training Act.
 
9    Section 10. Fund the Police Grant Fund; creation.
10    (a) The Fund the Police Grant Fund is created as a special
11fund in the State treasury. From appropriations to the Board
12from the Fund, the Board must make grants to units of local
13government and Illinois public universities for the purposes
14of:
15        (1) hiring and retention of law enforcement officers,
16    including hiring and retention incentives and overtime;
17        (2) providing mental health care for law enforcement
18    officers;
19        (3) purchasing public safety equipment designed to
20    prevent gang violence, motor vehicle theft, vehicular
21    hijacking, or the sale of contraband; and
22        (4) training for law enforcement officers in

2    hijacking, or the sale of contraband.
3    Moneys received for the purposes of this Section,
4including, but not limited to, fee receipts, gifts, grants,
5and awards from any public or private entity, must be
6deposited into the Fund. Any interest earned on moneys in the
7Fund must be deposited into the Fund.
8    (b) The Board may by rule set requirements for the
9distribution of grant moneys and determine which law
10enforcement agencies are eligible.
11    (c) The Board shall consider compliance with the Uniform
12Crime Reporting Act as a factor in awarding grant moneys.
 
13    Section 15. No fund sweep; transfer.
14    (a) Notwithstanding any other provision of law, moneys in
15the Fund the Police Grant Fund may not be appropriated,
16assigned, or transferred to another State fund.
17    (b) As soon as practical after the effective date of this
18Act, the State Comptroller shall direct and the State
19Treasurer shall transfer the sum of $100,000,000 from the
20General Revenue Fund to the Fund the Police Grant Fund.
 
21    Section 90.The State Finance Act is amended by adding
22Section 5.970 as follows:
