    Amends the Illinois Income Tax Act. Creates a tax checkoff for the Illinois DREAM Fund. Amends the Higher Education Student Assistance Act to provide that moneys from the checkoff may be received by the Fund. Effective immediately.

1    AN ACT concerning revenue.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Income Tax Act is amended by adding
5Section 507GGG as follows:
 
6    (35 ILCS 5/507GGG new)
7    Sec. 507GGG. Illinois DREAM Fund checkoff. For taxable
8years ending on or after December 31, 2017, the Department
9shall print on its standard individual income tax form a
10provision indicating that if the taxpayer wishes to contribute
11to the Illinois DREAM Fund created under Section 67 of the
12Higher Education Student Assistance Act, as authorized by this
13amendatory Act of the 100th General Assembly, he or she may do
14so by stating the amount of the contribution (not less than $1)
15on the return, and that the contribution will reduce the
16taxpayer's refund or increase the amount of payment to
17accompany the return. Failure to remit any amount of increased
18payment shall reduce the contribution accordingly. This
19Section shall not apply to any amended return.
 
20    Section 10. The Higher Education Student Assistance Act is
21amended by changing Section 67 as follows:

2    Sec. 67. Illinois DREAM Fund Commission.
3    (a) The Illinois Student Assistance Commission shall
4establish an Illinois DREAM Fund Commission. The Governor shall
5appoint, with the advice and consent of the Senate, members to
6the Illinois DREAM Fund Commission, which shall be comprised of
79 members representing the geographic and ethnic diversity of
8this State, including students, college and university
9administrators and faculty, and other individuals committed to
10advancing the educational opportunities of the children of
11immigrants.
12    (b) The Illinois DREAM Fund Commission is charged with all
13of the following responsibilities:
14        (1) Administering this Section and raising funds for
15    the Illinois DREAM Fund.
16        (2) Establishing a not-for-profit entity charged with
17    raising funds for the administration of this Section, any
18    educational or training programs the Commission is tasked
19    with administering, and funding scholarships to students
20    who are the children of immigrants to the United States.
21        (3) Publicizing the availability of scholarships from
22    the Illinois DREAM Fund.
23        (4) Selecting the recipients of scholarships funded
24    through the Illinois DREAM Fund.
25        (5) Researching issues pertaining to the availability
26    of assistance with the costs of higher education for the

1    children of immigrants and other issues regarding access
2    for and the performance of the children of immigrants
3    within higher education.
4        (6) Overseeing implementation of the other provisions
5    of this amendatory Act of the 97th General Assembly.
6        (7) Establishing and administering training programs
7    for high school counselors and counselors, admissions
8    officers, and financial aid officers of public
9    institutions of higher education. The training programs
10    shall instruct participants on the educational
11    opportunities available to college-bound students who are
12    the children of immigrants, including, but not limited to,
13    in-state tuition and scholarship programs. The Illinois
14    DREAM Fund Commission may also establish a public awareness
15    campaign regarding educational opportunities available to
16    college bound students who are the children of immigrants.
17    The Illinois DREAM Fund Commission shall establish, by
18rule, procedures for accepting and evaluating applications for
19scholarships from the children of immigrants and issuing
20scholarships to selected student applicants.
21    (c) To receive a scholarship under this Section, a student
22must meet all of the following qualifications:
23        (1) Have resided with his or her parents or guardian
24    while attending a public or private high school in this
25    State.
26        (2) Have graduated from a public or private high school

1    or received the equivalent of a high school diploma in this
2    State.
3        (3) Have attended school in this State for at least 3
4    years as of the date he or she graduated from high school
5    or received the equivalent of a high school diploma.
6        (4) Have at least one parent who immigrated to the
7    United States.
8    (d) The Illinois Student Assistance Commission shall
9establish an Illinois DREAM Fund to provide scholarships under
10this Section. The Illinois DREAM Fund shall be funded entirely
11from private contributions and from moneys received from the
12tax checkoff established under Section 506GGG of the Illinois
13Income Tax Act.

15    Section 99. Effective date. This Act takes effect upon
16becoming law.
