1    AN ACT concerning local government.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The Illinois Municipal Code is amended by
5changing Sections 3.1-15-15 and 8-2-9.1 as follows:

7    Sec. 3.1-15-15. Holding other offices. A mayor, president,
8alderman, trustee, clerk, or treasurer shall not hold any other
9office under the municipal government during the term of that
10office, except when the officer is granted a leave of absence
11from that office or except as otherwise provided in Sections
123.1-10-50, and 3.1-35-135, and 8-2-9.1. Moreover, an officer
13may serve as a volunteer fireman and receive compensation for
14that service.

17    Sec. 8-2-9.1. Budget officer. Every municipality with a
18population of less than 500,000 (except special charter
19municipalities having a population in excess of 50,000) that
20has adopted this Section 8-2-9.1 and Sections 8-2-9.2 through
218-2-9.10 by a two-thirds majority vote of those members of the
22corporate authorities then holding office shall have a budget

1officer who shall be designated by the mayor or president, with
2the approval of the corporate authorities. In municipalities
3operating under the commission form of government, the
4commissioner of accounts and finances shall designate the
5budget officer, with the approval of the council or board of
6trustees, as the case may be. In municipalities with a
7managerial form of government, the municipal manager shall
8designate the budget officer. The budget officer shall take an
9oath and post a bond as provided in Section 3.1-10-25. The
10budget officer may hold another municipal office, either
11elected or appointed (including, but not limited to, the office
12of mayor or president in municipalities with a population under
1310,000), and may receive compensation for both offices except
14when a mayor or president in a municipality with a population
15under 10,000 is also the budget officer. Article 10 of this
16Code shall not apply to an individual serving as the budget
17officer. The budget officer shall serve at the pleasure of the
18mayor or municipal manager, as the case may be.

20    Section 99. Effective date. This Act takes effect upon
21becoming law.
