SYNOPSIS AS INTRODUCED:

Amends the State Finance Act. Creates the Illinois African American Family Commission Fund as a special fund in the State treasury. Amends the Illinois Vehicle Code to provide for the issuance of Illinois African American Family Pride plates. Provides that the applicant shall pay an additional fee of $35 for original issuance of the plates, of which $20 shall be deposited into the Illinois African American Family Commission Fund and $15 shall be deposited into the Secretary of State Special License Plate Fund. Provides that an additional fee of $22 shall be charged for each renewal, of which $20 shall be deposited into the Illinois African American Family Commission Fund and $2 shall be deposited into the Secretary of State Special License Plate Fund. Provides that money in the Illinois African American Family Commission Fund shall be paid as grants to African American small business owners in Illinois to provide funding for administrative and operational needs deemed necessary to increase the capacity and growth of the business.

AN ACT concerning transportation.

Be it enacted by the People of the State of Illinois, represented in the General Assembly:

Section 5. The State Finance Act is amended by adding Section 5.866 as follows:

Sec. 5.866. The Illinois African American Family Commission Fund.

Section 10. The Illinois Vehicle Code is amended by adding Section 3-699.14 as follows:

Sec. 3-699.14. Illinois African American Family Pride plates.

(a) The Secretary, upon receipt of all applicable fees and applications made in the form prescribed by the Secretary of State, may issue special registration plates designated as Illinois African American Family Pride plates. The special plates issued under this Section shall be affixed only to passenger vehicles of the first division or motor vehicles of the second division weighing not more than 8,000 lbs. Plates issued under this Section shall expire according to the multi-year procedure established by Section 3-414.1 of this Code.

(b) The design and color of the special plates shall be wholly within the discretion of the Secretary. The Secretary may allow the plates to be issued as vanity plates or personalized under Section 3-405.1 of the Code. The Secretary shall prescribe stickers or decals as provided under Section 3-412 of this Code. Appropriate documentation, as determined by the Secretary, shall accompany each application.

(c) An applicant shall be charged a $35 fee for original issuance in addition to the appropriate registration fee, if applicable. Of this fee, $20 shall be deposited into the Illinois African American Family Commission Fund and $15 shall be deposited into the Secretary of State Special License Plate Fund. For each registration renewal period, a $22 fee, in addition to the appropriate registration fee, shall be charged. Of this fee, $20 shall be deposited into the Illinois African American Family Commission Fund and $2 shall be deposited into the Secretary of State Special License Plate Fund.

(d) The Illinois African American Family Commission Fund is created as a special fund in the State treasury. All moneys in the Illinois African American Family Commission Fund shall be paid, subject to appropriation by the General Assembly and distribution by the Secretary, as grants to African American small business owners in Illinois to provide funding for administrative and operational needs deemed necessary to increase the capacity and growth of the business.
