    Amends the Public Community College Act and various Acts relating to the governance of public universities in Illinois. Provides that the tuition and fee rates for students for the 2011-2012 and 2012-2013 academic years must not be more than the tuition and fees rates in effect for the 2010-2011 academic year. Effective immediately.

1    AN ACT concerning education.
 
2    Be it enacted by the People of the State of Illinois,
3represented in the General Assembly:
 
4    Section 5. The University of Illinois Act is amended by
5changing Section 25 as follows:
 
6    (110 ILCS 305/25)
7    Sec. 25. Limitation on tuition and fee increase.
8    (a) This subsection (a) Section applies only to those
9students who first enroll after the 2003-2004 academic year.
10For 4 continuous academic years following initial enrollment
11(or for undergraduate programs that require more than 4 years
12to complete, for the normal time to complete the program, as
13determined by the University), the tuition charged an
14undergraduate student who is an Illinois resident shall not
15exceed the amount that the student was charged at the time he
16or she first enrolled in the University. However, if the
17student changes majors during this time period, the tuition
18charged the student shall equal the amount the student would
19have been charged had he or she been admitted to the changed
20major when he or she first enrolled. An undergraduate student
21who is an Illinois resident and who has for 4 continuous
22academic years been charged no more than the tuition amount
23that he or she was charged at the time he or she first enrolled

1in the University shall be charged tuition not to exceed the
2amount the University charged students who first enrolled in
3the University for the academic year following the academic
4year the student first enrolled in the University for a maximum
5of 2 additional continuous academic years.
6    (b) Notwithstanding subsection (a) of this Section, the
7tuition and fee rates for undergraduate and graduate resident
8and non-resident students for the 2011-2012 and 2012-2013
9academic years must not be more than the tuition and fee rates
10in effect for the 2010-2011 academic year.

12    Section 10. The Southern Illinois University Management
13Act is amended by changing Section 15 as follows:
 
14    (110 ILCS 520/15)
15    Sec. 15. Limitation on tuition and fee increase.

17students who first enroll after the 2003-2004 academic year.
18For 4 continuous academic years following initial enrollment
19(or for undergraduate programs that require more than 4 years

14    Section 30. The Illinois State University Law is amended by
15changing Section 20-125 as follows:

19students who first enroll after the 2003-2004 academic year.
20For 4 continuous academic years following initial enrollment

21    Section 35. The Northeastern Illinois University Law is
22amended by changing Section 25-120 as follows:

2    Section 40. The Northern Illinois University Law is amended
3by changing Section 30-130 as follows:

5    Sec. 30-130. Limitation on tuition and fee increase.
6    (a) This subsection (a) Section applies only to those
7students who first enroll after the 2003-2004 academic year.
8For 4 continuous academic years following initial enrollment
9(or for undergraduate programs that require more than 4 years
10to complete, for the normal time to complete the program, as
11determined by the University), the tuition charged an
12undergraduate student who is an Illinois resident shall not
13exceed the amount that the student was charged at the time he
14or she first enrolled in the University. However, if the
15student changes majors during this time period, the tuition
16charged the student shall equal the amount the student would
17have been charged had he or she been admitted to the changed

9    Section 45. The Western Illinois University Law is amended
10by changing Section 35-125 as follows:

12    Sec. 35-125. Limitation on tuition and fee increase.
13    (a) This subsection (a) Section applies only to those
14students who first enroll after the 2003-2004 academic year.
15For 4 continuous academic years following initial enrollment
16(or for undergraduate programs that require more than 4 years
17to complete, for the normal time to complete the program, as
18determined by the University), the tuition charged an
19undergraduate student who is an Illinois resident shall not
20exceed the amount that the student was charged at the time he
21or she first enrolled in the University. However, if the
22student changes majors during this time period, the tuition
23charged the student shall equal the amount the student would

12and non-resident students for the 2011-2012 and 2012-2013
13academic years must not be more than the tuition and fee rates
14in effect for the 2010-2011 academic year.

16    Section 50. The Public Community College Act is amended by
17changing Section 6-4 as follows:
 
18    (110 ILCS 805/6-4)  (from Ch. 122, par. 106-4)
19    Sec. 6-4. Variable rates and fees; limitation on tuition
20and fee increase.
21    (a) Any community college district, by resolution of the
22board, may establish variable tuition rates and fees for
23students attending its college in an amount not to exceed 1/3
24of the per capita cost as defined in Section 6-2, provided that

1voluntary contributions, as defined in Section 65 of the Higher
2Education Student Assistance Act, shall not be included in any
3calculation of community college tuition and fee rates for the
4purpose of this Section.
5    (b) Notwithstanding subsection (a) of this Section, the
6tuition and fee rates for resident and non-resident students
7for the 2011-2012 and 2012-2013 academic years must not be more
8than the tuition and fee rates in effect for the 2010-2011
9academic year.

11    Section 99. Effective date. This Act takes effect upon
12becoming law.
