Amends the Illinois Vehicle Code. Beginning with the 2017 registration year, changes the registration periods for vehicles of the first division, vehicles of the second division under 8,000 lbs., motorcycles, motor driven cycles, recreational vehicles, and campers, from annual registration to biennial registration. Makes other conforming changes. Amends the Cycle Rider Safety Training Act to make conforming changes. Effective January 1, 2017.

| 2 | | Be it enacted by the People of the State of Illinois,
| 3 | | represented in the General Assembly:
| 4 | | Section 5. The Illinois Vehicle Code is amended by changing | 5 | | Sections 1-171, 2-119, 3-403, 3-412, 3-413, 3-414, 3-414.1, | 6 | | 3-415, 3-607, 3-626, 3-803, 3-805.5, 3-806, 3-815, and 11-1303 | 7 | | as follows:
| 8 | | (625 ILCS 5/1-171) (from Ch. 95 1/2, par. 1-171)
| 9 | | Sec. 1-171. Registration - Registration Sticker. | 10 | | Registration. The registration certificate or certificates, | 11 | | registration
plates and registration stickers issued under the | 12 | | laws of this State pertaining
to the registration of vehicles.
| 13 | | Registration Sticker or Stickers. A device or devices to be | 14 | | attached to
a rear registration plate that will renew the | 15 | | registration and registration
plate or plates for a | 16 | | pre-determined period not to exceed 2 one registration
years | 17 | | year except as provided in subsection (1) of Section 3-414 of | 18 | | this Code.
Should the Secretary of State determine it is | 19 | | advisable to require a registration
sticker to be attached to a | 20 | | front registration plate, he may require such
action and | 21 | | provide the necessary additional sticker. Such determination
| 22 | | shall be publicly announced at least 30 days in advance of a | 23 | | new annual
registration period year .

| 3 | | Sec. 2-119. Disposition of fees and taxes.
| 4 | | (a) All moneys received from Salvage Certificates shall be | 5 | | deposited in
the Common School Fund in the State Treasury.
| 6 | | (b) Of the money collected for each certificate of title, | 7 | | duplicate certificate of title, and corrected certificate of | 8 | | title: | 9 | | (1) $2.60 shall be deposited in the Park and | 10 | | Conservation Fund; | 11 | | (2) $0.65 shall be deposited in the Illinois Fisheries | 12 | | Management Fund; | 13 | | (3) $48 shall be disbursed under subsection (g) of this | 14 | | Section; | 15 | | (4) $4 shall be deposited into the Motor Vehicle | 16 | | License Plate Fund; and | 17 | | (5) $30 shall be deposited into the Capital Projects | 18 | | Fund. | 19 | | All remaining moneys collected for certificates of title, | 20 | | and all moneys collected for filing of security interests, | 21 | | shall be deposited in the General Revenue Fund. | 22 | | The $40 $20 collected for each delinquent vehicle | 23 | | registration renewal fee shall be deposited into the General | 24 | | Revenue Fund. | 25 | | The moneys deposited in the Park and Conservation Fund |

| 1 | | under this Section shall be used for the acquisition and | 2 | | development of bike paths as provided for in Section 805-420 of | 3 | | the Department of Natural Resources (Conservation) Law of the | 4 | | Civil Administrative Code of Illinois. The moneys deposited | 5 | | into the Park and Conservation Fund under this subsection shall | 6 | | not be subject to administrative charges or chargebacks, unless | 7 | | otherwise authorized by this Code. | 8 | | If the balance in the Motor Vehicle License Plate Fund | 9 | | exceeds $40,000,000 on the last day of a calendar month, then | 10 | | during the next calendar month, the $4 that otherwise would be | 11 | | deposited in that fund shall instead be deposited into the Road | 12 | | Fund.
| 13 | | (c) All moneys collected for that portion of a driver's | 14 | | license fee
designated for driver education under Section 6-118 | 15 | | shall be placed in
the Driver Education Fund in the State | 16 | | Treasury.
| 17 | | (d) Of the moneys collected as a registration fee for each | 18 | | motorcycle, motor driven cycle, and moped, 27% shall be | 19 | | deposited in the Cycle Rider Safety Training Fund.
| 20 | | (e) (Blank).
| 21 | | (f) Of the total money collected for a commercial learner's | 22 | | permit (CLP) or
original or renewal issuance of a commercial | 23 | | driver's license (CDL)
pursuant to the Uniform Commercial | 24 | | Driver's License Act (UCDLA): (i) $6 of the
total fee for an | 25 | | original or renewal CDL, and $6 of the total CLP fee when such | 26 | | permit is issued to any person holding a
valid Illinois |

| 1 | | driver's license, shall be paid into the CDLIS/AAMVAnet/NMVTIS
| 2 | | Trust Fund (Commercial Driver's License Information | 3 | | System/American
Association of Motor Vehicle Administrators | 4 | | network/National Motor Vehicle Title Information Service Trust | 5 | | Fund) and shall
be used for the purposes provided in Section | 6 | | 6z-23 of the State Finance Act
and (ii) $20 of the total fee | 7 | | for an original or renewal CDL or CLP shall be paid
into the | 8 | | Motor Carrier Safety Inspection Fund, which is hereby created | 9 | | as a
special fund in the State Treasury, to be used by
the | 10 | | Department
of State Police, subject to appropriation, to hire | 11 | | additional officers to
conduct motor carrier safety
| 12 | | inspections
pursuant to Chapter 18b of this Code.
| 13 | | (g) Of the moneys received by the Secretary of State as | 14 | | registration fees or taxes, certificates of title, duplicate | 15 | | certificates of title, corrected certificates of title, or as | 16 | | payment of any other fee under this Code, when those moneys are | 17 | | not otherwise distributed by this Code, 37% shall be deposited | 18 | | into the State Construction Account Fund, and 63% shall be | 19 | | deposited in the Road Fund. Moneys in the Road Fund shall be | 20 | | used for the purposes provided in Section 8.3 of the State | 21 | | Finance Act.

| 25 | | (k) There is created in the State Treasury a special fund | 26 | | to be known as
the Secretary of State Special License Plate |

| 1 | | Fund. Money deposited into the
Fund shall, subject to | 2 | | appropriation, be used by the Office of the Secretary
of State | 3 | | (i) to help defray plate manufacturing and plate processing | 4 | | costs
for the issuance and, when applicable, renewal of any new | 5 | | or existing
registration plates authorized under this Code and | 6 | | (ii) for grants made by the
Secretary of State to benefit | 7 | | Illinois Veterans Home libraries.
| 8 | | (l) The Motor Vehicle Review Board Fund is created as a | 9 | | special fund in
the State Treasury. Moneys deposited into the | 10 | | Fund under paragraph (7) of
subsection (b) of Section 5-101 and | 11 | | Section 5-109 shall,
subject to appropriation, be used by the | 12 | | Office of the Secretary of State to
administer the Motor | 13 | | Vehicle Review Board, including without
limitation payment of | 14 | | compensation and all necessary expenses incurred in
| 15 | | administering the Motor Vehicle Review Board under the Motor | 16 | | Vehicle Franchise
Act.
| 17 | | (m) Effective July 1, 1996, there is created in the State
| 18 | | Treasury a special fund to be known as the Family | 19 | | Responsibility Fund. Moneys
deposited into the Fund shall, | 20 | | subject to appropriation, be used by the Office
of the | 21 | | Secretary of State for the purpose of enforcing the Family | 22 | | Financial
Responsibility Law.
| 23 | | (n) The Illinois Fire Fighters' Memorial Fund is created as | 24 | | a special
fund in the State Treasury. Moneys deposited into the | 25 | | Fund shall, subject
to appropriation, be used by the Office of | 26 | | the State Fire Marshal for
construction of the Illinois Fire |

| 1 | | Fighters' Memorial to be located at the
State Capitol grounds | 2 | | in Springfield, Illinois. Upon the completion of the
Memorial, | 3 | | moneys in the Fund shall be used in accordance with Section | 4 | | 3-634.
| 5 | | (o) Of the money collected for each certificate of title | 6 | | for all-terrain
vehicles and off-highway motorcycles, $17 | 7 | | shall be deposited into the
Off-Highway Vehicle Trails Fund.
| 8 | | (p) For audits conducted on or after July 1, 2003 pursuant | 9 | | to Section
2-124(d) of this Code, 50% of the money collected as | 10 | | audit fees shall be
deposited
into the General Revenue Fund.

| 16 | | Sec. 3-403. Trip and Short-term permits.
| 17 | | (a) The Secretary of State may issue a short-term permit to | 18 | | operate a
nonregistered first or second division vehicle within | 19 | | the State of Illinois
for a period of not more than 7 days. Any | 20 | | second division vehicle
operating
on such permit may operate | 21 | | only on empty weight. The fee for the
short-term permit shall | 22 | | be $6 for permits purchased on
or before June 30, 2003
and $10 | 23 | | for permits purchased on or after July 1, 2003. For short-term
| 24 | | permits purchased on or after July 1, 2003, $4 of the fee | 25 | | collected for the
purchase of each permit shall be deposited |

| 1 | | into the General Revenue Fund.
| 2 | | This permit may also be issued to operate an unladen | 3 | | registered vehicle
which is suspended under the Vehicle | 4 | | Emissions Inspection Law and allow it
to be driven on the roads | 5 | | and highways of the State in order to be repaired
or when | 6 | | travelling to and from an emissions inspection station.
| 7 | | (b) The Secretary of State may, subject to reciprocal | 8 | | agreements,
arrangements or declarations made or entered into | 9 | | pursuant to Section
3-402, 3-402.4 or by rule, provide for and | 10 | | issue registration permits for
the use of Illinois highways by | 11 | | vehicles of the second division on an
occasional basis or for a | 12 | | specific and special short-term use, in
compliance with rules | 13 | | and regulations promulgated by the Secretary of
State, and upon | 14 | | payment of the prescribed fee as follows:
| 15 | | One-trip permits. A registration permit for one trip, or | 16 | | one round-trip
into and out of Illinois, for a period not to | 17 | | exceed 72 consecutive hours
or 3 calendar days may be provided, | 18 | | for a fee as prescribed in Section 3-811.
| 19 | | One-Month permits. A registration permit for 30 days may be | 20 | | provided for
a fee of $13 for registration plus 1/10 of the | 21 | | flat weight tax.
The minimum fee for such permit shall be $31.
| 22 | | In-transit permits. A registration permit for one trip may | 23 | | be provided
for vehicles in transit by the driveaway or towaway | 24 | | method and operated
by a transporter in compliance with the | 25 | | Illinois Motor Carrier of Property
Law, for a fee as prescribed | 26 | | in Section 3-811.

| 1 | | Illinois Temporary Apportionment Authorization Permits. An | 2 | | apportionment
authorization permit for forty-five days for the | 3 | | immediate operation of
a vehicle upon application for and prior | 4 | | to receiving apportioned credentials
or interstate credentials | 5 | | from the State of Illinois. The fee for
such permit shall be | 6 | | $3.
| 7 | | Illinois Temporary Prorate Authorization Permit. A prorate | 8 | | authorization
permit for forty-five days for the immediate | 9 | | operation of a vehicle upon
application for and prior to | 10 | | receiving prorate credentials or interstate
credentials from | 11 | | the State of Illinois. The fee for such permit shall be
$3.
| 12 | | (c) The Secretary of State shall promulgate by such rule or | 13 | | regulation,
schedules of fees and taxes for such permits and in | 14 | | computing the amount
or amounts due, may round off such amount | 15 | | to the nearest full dollar amount.
| 16 | | (d) The Secretary of State shall further prescribe the form | 17 | | of application
and permit and may require such information and | 18 | | data as necessary and proper,
including confirming the status | 19 | | or identity of the applicant and the vehicle
in question.
| 20 | | (e) Rules or regulations promulgated by the Secretary of | 21 | | State under this
Section shall provide for reasonable and | 22 | | proper limitations and restrictions
governing the application | 23 | | for and issuance and use of permits, and shall
provide for the | 24 | | number of permits per vehicle or per applicant, so as to
| 25 | | preclude evasion of annual registration requirements as may be | 26 | | required by
this Act.

| 1 | | (f) Any permit under this Section is subject to suspension | 2 | | or revocation
under this Act, and in addition, any such permit | 3 | | is subject to suspension
or revocation should the Secretary of | 4 | | State determine that the vehicle
identified in any permit | 5 | | should be properly registered in Illinois. In the
event any | 6 | | such permit is suspended or revoked, the permit is then null | 7 | | and
void, may not be re-instated, nor is a refund therefor | 8 | | available. The
vehicle identified in such permit may not | 9 | | thereafter be operated in
Illinois without being properly | 10 | | registered as provided in this Chapter.

| 13 | | Sec. 3-412. Registration plates and registration stickers | 14 | | to be
furnished by the Secretary of State. | 15 | | (a) The Secretary of State upon registering a vehicle | 16 | | subject to biennial annual
registration for the first time | 17 | | shall issue or shall cause to be issued to the
owner one | 18 | | registration plate for a motorcycle, trailer, semitrailer, | 19 | | moped, autocycle, or truck-tractor, 2 registration plates for | 20 | | other motor vehicles
and, where applicable, current | 21 | | registration stickers for motor vehicles of the
first division. | 22 | | The provisions of this Section may be made applicable to such
| 23 | | vehicles of the second division, as the Secretary of State may, | 24 | | from time to
time, in his discretion designate. On subsequent | 25 | | biennial annual registrations
during the term of the |

| 1 | | registration plate as provided in Section 3-414.1, the
| 2 | | Secretary shall issue or cause to be issued registration | 3 | | stickers as evidence
of current registration. However, the | 4 | | issuance of biennial annual registration stickers
to vehicles | 5 | | registered under the provisions of Sections 3-402.1 and 3-405.3 | 6 | | of
this Code may not be required if the Secretary deems the | 7 | | issuance unnecessary.
| 8 | | (b) Every registration plate shall have displayed upon it | 9 | | the registration
number assigned to the vehicle for which it is | 10 | | issued, the name of this State,
which may be abbreviated, the | 11 | | year number for which it was issued, which may
be abbreviated, | 12 | | the phrase "Land of Lincoln" (except as otherwise provided in
| 13 | | this Code), and such other letters or numbers as the Secretary
| 14 | | may prescribe. However, for apportionment plates issued to | 15 | | vehicles registered
under Section 3-402.1 and fleet plates | 16 | | issued to vehicles registered under
Section 3-405.3, the phrase | 17 | | "Land of Lincoln" may be omitted to allow for
the word | 18 | | "apportioned", the word "fleet", or other similar language to | 19 | | be
displayed. Registration plates issued to a vehicle | 20 | | registered as a fleet
vehicle may display a designation | 21 | | determined by the Secretary.
| 22 | | The Secretary may in his discretion prescribe
that letters | 23 | | be used as prefixes only on registration plates issued to | 24 | | vehicles
of the first division which are registered under this | 25 | | Code and only as suffixes
on registration plates issued to | 26 | | other vehicles. Every registration sticker

| 1 | | of current registration shall designate the year number
for | 2 | | which it is issued and such other letters or numbers as the | 3 | | Secretary may
prescribe and shall be of a contrasting color | 4 | | with the registration plates and
registration stickers of the | 5 | | previous registration period year .
| 6 | | (c) Each registration plate and the required letters and | 7 | | numerals thereon,
except the year number for which issued, | 8 | | shall be of sufficient size to be
plainly readable from a | 9 | | distance of 100 feet during daylight, and shall be
coated with | 10 | | reflectorizing material. The dimensions of the plate issued to
| 11 | | vehicles of the first division shall be 6 by 12 inches.
| 12 | | (d) The Secretary of State shall issue for every passenger | 13 | | motor vehicle
rented without a driver the same type of | 14 | | registration plates as the type of
plates issued for a private | 15 | | passenger vehicle.
| 16 | | (e) The Secretary of State shall issue for every passenger
| 17 | | car used as a taxicab or livery, distinctive registration | 18 | | plates.
| 19 | | (f) The Secretary of State shall issue for every motorcycle
| 20 | | distinctive registration plates distinguishing between
| 21 | | motorcycles having 150 or more cubic centimeters piston
| 22 | | displacement, or having less than 150 cubic centimeter
piston | 23 | | displacement.
| 24 | | (g) Registration plates issued to vehicles for-hire may
| 25 | | display a designation as determined by the Secretary that
such | 26 | | vehicles are for-hire.

| 1 | | (h) (Blank).
| 2 | | (i) The Secretary of State shall issue for every public and | 3 | | private
ambulance registration plates identifying the vehicle | 4 | | as an ambulance.
The Secretary shall forward to the Department | 5 | | of Healthcare and Family Services registration
information for | 6 | | the purpose of verification of claims filed with the
Department | 7 | | by ambulance owners for payment for services to public | 8 | | assistance
recipients.
| 9 | | (j) The Secretary of State shall issue for every public and | 10 | | private
medical carrier or rescue vehicle livery registration | 11 | | plates displaying
numbers within ranges of numbers reserved | 12 | | respectively for medical carriers
and rescue vehicles. The | 13 | | Secretary shall forward to the Department of Healthcare and | 14 | | Family Services registration information for the purpose of | 15 | | verification of claims filed
with the Department by owners of | 16 | | medical carriers or rescue vehicles for
payment for services to | 17 | | public assistance recipients.
| 18 | | (k) The Secretary of State shall issue distinctive license | 19 | | plates or distinctive license plate stickers for every vehicle | 20 | | exempted from subsections (a) and (a-5) of Section 12-503 by | 21 | | subsection (g) of that Section, and by subsection (g-5) of that | 22 | | Section before its deletion by this amendatory Act of the 95th | 23 | | General Assembly. The Secretary shall issue these plates or | 24 | | stickers immediately upon receiving the physician's | 25 | | certification required under subsection (g) of Section 12-503. | 26 | | New plates or stickers shall also be issued when the |

| 1 | | certification is renewed as provided in that subsection.
| 2 | | (l) The Secretary of State shall issue distinctive | 3 | | registration plates for low-speed vehicles. | 4 | | (m) The Secretary of State shall issue distinctive | 5 | | registration plates for autocycles. The dimensions of the plate | 6 | | issued to autocycles shall be 4 by 7 inches. | 7 | | (Source: P.A. 98-777, eff. 1-1-15 .)

| 9 | | Sec. 3-413. Display of registration plates, registration | 10 | | stickers,
and drive-away permits; registration plate covers. | 11 | | (a) Registration plates issued for a
motor vehicle other | 12 | | than a motorcycle, autocycle, trailer, semitrailer,
| 13 | | truck-tractor, apportioned bus, or apportioned truck shall be | 14 | | attached
thereto, one in the front and one in the
rear. The | 15 | | registration plate issued for a motorcycle, autocycle, trailer | 16 | | or
semitrailer required to be registered hereunder and any | 17 | | apportionment
plate issued to a bus under the provisions of | 18 | | this Code shall be attached
to the rear thereof. The | 19 | | registration plate issued for a truck-tractor or
an apportioned | 20 | | truck required to be registered hereunder shall be
attached to | 21 | | the front thereof.
| 22 | | (b) Except for vehicles with rear loaded motorized | 23 | | forklifts, every registration plate shall at all times be | 24 | | securely fastened
in a horizontal position to the vehicle for | 25 | | which it is issued so as to
prevent the plate from swinging and |

| 1 | | at a height of not less than 5
inches from the ground, | 2 | | measuring from the bottom of such plate, in a
place and | 3 | | position to be clearly visible and shall be maintained in a
| 4 | | condition to be clearly legible, free
from any materials that | 5 | | would obstruct the visibility of the plate. A registration | 6 | | plate on a motorcycle may be mounted vertically as long as it | 7 | | is otherwise clearly visible. Registration stickers issued as
| 8 | | evidence of renewed biennial annual registration shall be | 9 | | attached to registration
plates as required by the Secretary of | 10 | | State, and be clearly visible at
all times. For those vehicles | 11 | | with rear loaded motorized forklifts, if the rear plate is | 12 | | securely fastened in a horizontal position as prescribed, the | 13 | | plate and registration sticker shall not be required to be | 14 | | clearly visible at all times as a result of the rear mounted | 15 | | motorized forklift obstructing the view.
| 16 | | (c) Every drive-away permit issued pursuant to this
Code | 17 | | shall
be firmly attached to the motor vehicle in the manner | 18 | | prescribed by the Secretary of State. If a drive-away permit is | 19 | | affixed to a motor vehicle in any other manner the
permit shall | 20 | | be void and of no effect.
| 21 | | (d) The Illinois prorate decal issued to a foreign | 22 | | registered
vehicle part of a fleet prorated or apportioned with | 23 | | Illinois, shall be
displayed on a registration plate and | 24 | | displayed on the front of such
vehicle in the same manner as an | 25 | | Illinois registration plate.

truck displaying registration plates shall be attached to | 2 | | the rear of

after this | 18 | | amendatory Act of 1991 takes effect.

| 8 | | (d) Two-year Registrations. The fees and taxes prescribed | 9 | | by
Section 3-808 for 2-year registrations shall not be reduced | 10 | | in any
event. However, the fees and taxes prescribed for all | 11 | | other 2-year
registrations by this Act, shall be reduced as | 12 | | follows:
| 13 | | By 25% on and after June 15;
| 14 | | By 50% on and after December 15;
| 15 | | By 75% on and after the next ensuing June 15.
| 16 | | (e) The registration fees and taxes imposed upon certain | 17 | | vehicles

| 11 | | The changes to this Section made by Public Act 84-210 take | 12 | | effect with the 1986 Calendar Registration Year.
| 13 | | (g) Reductions shall in no event result in payment of a fee | 14 | | or tax less
than $6, and the Secretary of State shall | 15 | | promulgate schedules of fees
reflecting applicable reductions. | 16 | | Where any reduced amount is not stated in
full dollars, the | 17 | | Secretary of State may adjust the amount due to the nearest
| 18 | | full dollar amount.
| 19 | | (h) The reductions provided for in subsections (a) through | 20 | | (g) of this

| 7 | | f. Alongside or opposite any street excavation or | 8 | | obstruction when
stopping, standing or parking would | 9 | | obstruct traffic;
| 10 | | g. Upon any bridge or other elevated structure upon | 11 | | a highway
or within a highway tunnel;
| 12 | | h. On any railroad tracks. A violation of any part | 13 | | of this
subparagraph h. shall result in a mandatory | 14 | | fine of $500 or 50 hours of
community service.
| 15 | | i. At any place where official signs prohibit | 16 | | stopping;
| 17 | | j. On any controlled-access highway;
| 18 | | k. In the area between roadways of a divided | 19 | | highway, including
crossovers;
| 20 | | l. In a public parking area if the vehicle does not | 21 | | display a current
annual registration sticker or | 22 | | current temporary permit pending registration.
| 23 | | 2. Stand or park a vehicle, whether occupied or not, | 24 | | except momentarily
to pick up or discharge passengers:
| 25 | | a. In front of a public or private driveway;
| 26 | | b. Within 15 feet of a fire hydrant;

| 6 | | e. Within 20 feet of the driveway entrance to any | 7 | | fire station and on
the side of a street opposite the | 8 | | entrance to any fire station within 75
feet of such | 9 | | entrance (when properly sign-posted);
| 10 | | f. At any place where official signs prohibit | 11 | | standing.
| 12 | | 3. Park a vehicle, whether occupied or not, except | 13 | | temporarily for the
purpose of and while actually engaged | 14 | | in loading or unloading
property or passengers:
| 15 | | a. Within 50 feet of the nearest rail of a railroad | 16 | | crossing;
| 17 | | b. At any place where official signs prohibit | 18 | | parking.
| 19 | | (b) No person shall move a vehicle not lawfully under his | 20 | | control into
any such prohibited area or away from a curb such | 21 | | distance as is unlawful.

Illinois Vehicle Code, which amount the State | 10 | | Comptroller shall transfer
quarterly to a trust fund outside of | 11 | | the State treasury to be known as the
Cycle Rider Safety | 12 | | Training Fund, which is hereby created. In addition, the
| 13 | | Department may accept any federal, State, or private moneys for | 14 | | deposit into
the Fund and shall be used by the Department only | 15 | | for the expenses of the
Department in administering the | 16 | | provisions of this Act, for funding of
contracts with approved | 17 | | Regional Cycle Rider Safety Training Centers for the
conduct of | 18 | | courses, or for any purpose related or incident thereto and
| 19 | | connected therewith.
